The State and Cantabria will negotiate the Environmental Control Law due to discrepancies
Por FactBox Admin

The Bilateral Cooperation Commission of the General State Administration–Autonomous Community of Cantabria has agreed to initiate negotiations to resolve the discrepancies expressed regarding articles 6 and 44, the first additional provision, and the second and third transitional provisions of Cantabria Law 9/2026, of July 23, on Environmental Control. The agreement is published in the Official Gazette of Cantabria no. 213, of November 5, 2026, section 7.5 (Miscellaneous), by means of the Resolution of October 14, 2026, of the General Secretariat of the Ministry of Presidency, Justice, Security, and Administrative Simplification, with official reference CVE-2026-8126 (pp. 56524-56525).
The regulation subject to the conflict is Cantabria Law 9/2026, approved on July 23, 2026, and published in the Official Gazette of Cantabria on July 29, 2026. According to subsequent announcements in the same gazette, its sixth final provision established a vacatio legis of one month, meaning it entered into force on August 29, 2026. The law replaces and repeals Law 17/2006, of December 11, on Integrated Environmental Control, and establishes a new regulatory framework for administrative intervention and environmental assessment in the Autonomous Community.
The text is based on basic state legislation, particularly Law 21/2013, of December 9, on environmental assessment, which transposes European directives on the assessment of plans, programs, and projects. It also develops the regional land-use planning framework of Law 5/2022, of July 15, and practically replaces the previous regulation, Decree 19/2010, of March 18.
The provisions subject to negotiation
The agreement identifies five specific points of jurisdictional friction, without detailing the material content of each discrepancy in the published text:
- Article 6 of the law.
- Article 44 of the law.
- The first additional provision.
- The second transitional provision.
- The third transitional provision.
This is, therefore, a limited discrepancy: the remainder of the articles of Cantabria Law 9/2026 are not included in the opened procedure.
Working group and communication to the Constitutional Court
The Agreement of the Bilateral Commission, incorporated as an annex to the resolution, contains three mandates:
- To initiate negotiations to resolve the discrepancies expressed regarding the cited provisions.
- To designate a Working Group to propose the appropriate solution to the Bilateral Cooperation Commission.
- To communicate the agreement to the Constitutional Court through any of the bodies mentioned in article 33.2 of Organic Law 2/1979, of October 3, of the Constitutional Court, and to insert it in the Official State Gazette and the Official Gazette of Cantabria.
The publication in the BOC was arranged in accordance with Article 10 of Decree 18/2010, of March 18, which regulates the Official Gazette of Cantabria.
Signatories and immediate background
The agreement is signed by the Minister of Territorial Policy and Democratic Memory, Ángel Víctor Torres Pérez, and by the Councilor for Presidency, Justice, Security, and Administrative Simplification, María Isabel Urrutia de los Mozos. The resolution ordering its publication bears the signature of the general secretary of that department, María Eugenia Gutiérrez Palacio, and is dated in Santander on October 14, 2026.
This is not the first case of this type in the current session period. The same Bilateral Commission agreed on July 27, 2026, to open negotiations on eleven articles, one additional provision, and one final provision of Cantabria Law 8/2026, of June 23, on the Regulation of Maritime Transport in Cantabria; that agreement was published in the Official Gazette of Cantabria no. 179, of September 17, 2026 (CVE-2026-6848), and was subject to a correction of errors in no. 201, of October 20, 2026 (CVE-2026-8163).
Impact for companies and developers
The opening of negotiations does not suspend the validity of Cantabria Law 9/2026, which remains the applicable regulation for licenses and environmental assessment procedures processed by companies, developers, and city councils in Cantabria. The outcome of the Working Group may result in an agreed regulatory modification or, if no agreement is reached, a ruling by the Constitutional Court regarding articles 6 and 44 and the contested additional and transitional provisions.
