El Consell regula las comisiones de servicio del profesorado no universitario valenciano

The Consell has approved Decree 140/2026, of October 1, which regulates the service commissions of teaching civil servants within the management scope of the Generalitat. The regulation, published in the Official Gazette of the Generalitat Valenciana (DOGV) no. 10468, of October 8, 2026, within section I of general provisions, enters into force the day following its publication and will be applied starting from the 2026/2027 academic year.

First complete regulation of the non-university teaching sector

Until now, there was no provision in the Comunitat Valenciana that developed article 117 of Law 4/2021, of April 16, on the Valencian public service, regarding service commissions for teaching staff. The decree, promoted by the Department of Education, Culture and Universities, fills this gap and extends the regime to all non-university teaching bodies regulated in Organic Law 2/2006, of May 3, on education.

The regulation defines the service commission as a voluntary, temporary, and exceptional form of provision, applicable to vacant positions or those pending definitive provision when there is an urgent and unavoidable need identified within the framework of educational planning. The text consists of 20 articles, two additional provisions, one transitional, one repealing, and two final provisions, and it may not increase the department’s expenditure allocation.

Four modalities and three cases of priority granting

The decree organizes the granting into four modalities:

  • Commissions for personal, family, or health reasons.
  • Commissions for professional interest.
  • Commissions for the performance of the position of director of educational centers.
  • Commissions for the performance of positions of a singular nature.

Regardless of the annual call, three cases may be requested at any time and resolved with priority over the rest: the protection of victims of gender-based violence, the existence of a medical-labor fitness report advising against remaining in the position, and situations of serious aggression suffered by teaching staff in the exercise of their duties. These requests are excluded from any nominative publication and will be processed with guarantees of confidentiality.

Requirements, scoring, and adjudication criteria

Career civil servants in active service, special services, or leave for the care of relatives may participate, provided they belong to the same body, scale, or professional group as the requested position and certify, when required, a minimum C1 level of Valencian registered in the teacher training account.

  • In the personal, family, or health modality, the order of priority is: serious illness or disability of the applicant; serious illness, grade III dependency, or disability equal to or greater than 65% of a first-degree relative; reconciliation—with children or foster minors under 16 years of age—; and holding an elected office.
  • In the professional interest modality, the arrangement is based on the score obtained in the last transfer competition call, acting as a subsidiary to the latter.
  • Profile positions are filled through a reasoned proposal from the center’s management, endorsed by the school council and validated by the joint technical commission.
  • Positions of a singular nature are selected with a testing phase of 60% and a competition phase of 40%, with complementary criteria limited to 20% of the latter.

The general directorate competent in teaching personnel matters will resolve the requests and publish the list of grants and denials on the conselleria’s website. Scoring commissions and a joint technical commission with union representation from the education sectoral table are planned. After the application period, the provisional list of admitted and excluded candidates will be published, with ten days to correct defects.

Duration and electronic processing

Commissions will generally have a duration of one academic year, extendable to two when the call justifies it, with the possibility of renewal provided that the initial period and its extensions do not exceed the maximum limit of two years set in article 117.2 of Law 4/2021. Those coming from other educational administrations will last one academic year.

Participation shall be mandatory via electronic means, through the enabled applications, and will be supported by information already registered in the standardized electronic teaching file (EDEN), in order to reduce documentary burdens and processing times. The decree is signed by the president of the Generalitat, Juan Francisco Pérez Llorca, and the counselor of Education, Culture, and Universities, María del Carmen Ortí Ferre.

The new framework affects thousands of teaching officials in the Comunitat Valenciana, who will have for the first time a regulated, objective, and published procedure to change their destination on a temporary basis outside of the transfer competition. The progressive application of procedural aspects will allow the administration to maintain current procedures while adapting its computer systems.
