The Consell debuts its operating regulations and repeals the 1983 legislation

The Consell of the Generalitat Valenciana has had a new internal operating regulation since this Monday. Decree 137/2026, of September 25, approved by the Consell itself at the proposal of the Second Vice-Presidency and Conselleria of the Presidency, regulates the convening, deliberation, adoption of agreements, and publicity of the governing body and the Commission of Autonomous Secretariats and Sub-secretariats. The regulation is published in the Official Gazette of the Generalitat Valenciana (DOGV) no. 10460, of September 28, 2026, with the reference DOGV-C-2026-29881, and enters into force on the day of its publication.
The regulation develops the authorization provided for in Law 5/1983, of December 30, of the Consell, whose articles 15, 16, 17, and 26 establish the bases for the presidency, substitutions, the Secretariat of the Consell, and the preparatory commission for its meetings. The preamble justifies the revision due to the time elapsed—more than four decades—since the previous regulations, the increase in the Consell’s regulatory and management activity, and the development of electronic administration. The text was processed with the mandatory report of the Consell Jurídic Consultiu and is structured into four chapters and 21 articles.
Convening, quorum, and adoption of agreements
The Consell will meet upon convening by the Presidency, with ordinary sessions generally held weekly and extraordinary sessions for reasons of special institutional relevance or urgency. Notices of meetings will be sent by electronic means at least twelve hours in advance, except in urgent cases, and will include the agenda and documentation for the matters at hand.
- Constitution quorum: at least half of the members by right, including the Presidency and the Secretariat.
- Second call: one third of the members, with a minimum of three, always including the Presidency and Secretariat.
- Adoption of agreements: simple majority of those present; in the event of a tie, the vote of the Presidency decides.
- Headquarters: the city of València, although sessions may be held in any municipality of the Comunitat Valenciana.
- In-person meetings as a general rule; telematics only exceptionally and with justification.
The Commission of Autonomous Secretariats and Sub-secretariats
The decree creates the Commission of Autonomous Secretariats and Sub-secretariats as a preparatory body for the sessions of the Consell, without decision-making functions. Its presidency corresponds to the member of the Consell who serves as the Secretary of the Consell; it will have two vice-presidencies, memberships from the autonomous secretariats and sub-secretariats, and a secretariat exercised by the competent management center for relations with Les Corts.
The Commission shall meet prior to the sessions of the Consell, with a minimum notice of twenty-four hours in the summons, and its pronouncements may be a favorable report, a conditional report, postponement, or withdrawal. Urgent matters, reports, the appointment and dismissal of high-ranking officials, and the granting of honors and distinctions shall not require prior examination.
Transparency and publicity of agreements
The sessions of the Consell and the Commission shall be confidential, and only the nature of the agreements adopted shall be made public. An extract containing the list of matters dealt with and agreements adopted from each session shall be published on the Transparency Portal of the Generalitat (GVA Oberta), and the minutes shall be signed by the Secretariat of the Consell with the approval of the Presidency.
The Office of the Secretariat of the Consell shall process the publication in the DOGV of the provisions and agreements that must be published. Agreements containing political orientation guidelines, priorities, or common criteria of action, which shall not produce legal effects against third parties, are excluded from this publication. The regulation also incorporates rules for the correction of typos and material errors and a personal data protection clause.
Repeals and entry into force
The sole repealing provision nullifies the regulations in force since 1983 and subsequent rules on the matter:
- Decree 87/1983, of July 18, regulating the sessions of the Consell.
- Order of the Conseller of the Presidency of July 28, 1983, on the preparation, notification, and publication of agreements.
- Decree 197/2004, of October 1, on the Commission of Regional Secretaries and Undersecretaries.
- Decree 37/2020, of March 20, on the telematic functioning of governing bodies.
The decree shall have no impact on the expenditure chapters of the Generalitat’s budgets and shall be managed with its own personal and material resources. Matters in process without a decision from the Consell shall be resumed by the new Commission. The text is signed by President Juan Francisco Pérez Llorca and by the second Vice President and Conseller of the Presidency, José Luis Díez Climent.
The regulation establishes for the first time a complete and homogeneous procedure for the decisions of the Valencian Government, from the preparation of the matter to its certification and publication. For readers, the change translates into a single channel for the publicity of agreements through the Transparency Portal and explicit rules on quorum, notice periods, and conflicts of interest, which reinforces the traceability of what the Consell approves.
