El Consell condona los reintegros de las ayudas de la dana

The Consell has approved Decree-Law 8/2026, of October 30, which condones the repayments of extraordinary aid granted to alleviate the damages from the October 2024 DANA and the late-payment interests derived from those files. The regulation is published in the Official Gazette of the Generalitat Valenciana (DOGV) number 10484, of November 2, 2026, in section I of general provisions, with the official reference DOGV-C-2026-34062, and enters into force the following day, November 3, 2026.

Exceptional treatment for repayments

The decree-law is based on the fact that the aid management procedures were adapted to the urgency of the catastrophe, with a simplification of burdens and a payment regime oriented toward ensuring the money arrived as quickly as possible. The preamble argues that requiring the return of those amounts now “could represent a new economic hardship” for the affected persons, due to the destruction of documentation and the material difficulties of the subsequent months.

The legal authorization is based on Article 9.2 of Law 1/2015, of February 6, on public finance of the instrumental public sector and subsidies, and on Article 44.4 of the Statute of Autonomy, which allows the Consell to issue provisional legislative provisions due to extraordinary and urgent necessity. The text is subject to debate and voting in Les Corts. The condonation does not alter the substantive conditions of the aid nor the verification obligations: the competent bodies must verify who fits the subjective scope, and only then will the pardon apply.

The scope is limited to the lines expressly listed in Article 3, corresponding to seven Consell decrees:

  • Decree 163/2024, of November 4, urgent aid to alleviate the loss of basic necessity goods for natural persons.
  • Decree 172/2024, of November 26, employment maintenance and economic reactivation of companies.
  • Decree 176/2024, of December 3, aid for self-employed workers.
  • Decree 16/2025, of February 4, regulatory bases for self-employed workers.
  • Decree 5/2025, of January 14, compensation for the destruction of damaged vehicles.
  • Decree 83/2025, of June 3, new aid for damaged vehicles.
  • Decree 34/2025, of February 25, mobility and adaptation of vehicles for persons with disabilities and third-sector entities.

20,000 euro ceiling and ex officio procedure

Article 4 sets the maximum amount of the condonation at 20,000 euros per beneficiary person and aid. When the aid exceeds that figure, the difference must be repaid. The inclusion of a line in Article 3 does not by itself determine the eligibility for the pardon, which requires compliance with the subjective scope of the corresponding regulatory decree.

Chapter III extends the measure to the late-payment interest of the reimbursement proceedings for all Generalitat grants directly linked to the DANA between October 28 and November 4, 2024. Here, the scope is broader, both in terms of object and subject, and applies when the grants were funded or co-funded with the additional mechanisms authorized by the State and their guidelines were published in the 2024, 2025, and 2026 fiscal years.

In both cases, the waiver is applied ex officio, within the reimbursement procedure of Law 38/2003, of November 17, general on subsidies, and its regulation, approved by Royal Decree 887/2006, of July 21. The sole additional provision excludes reimbursements and interest already paid by the beneficiary before the entry into force.

Expandable credits for the “Endavant” plan

The first final provision modifies Article 25.1 of Law 4/2026, of July 22, on the Generalitat budgets for 2026, through a new letter ab). It grants expandable status to the credits destined for the Recovery and Reconstruction Plan of the Comunitat Valenciana, known as the “Endavant” plan, approved by agreement of the Consell on July 31, 2025, in accordance with Decree 3/2025, of January 8.

This expandable condition extends to the transfer lines that fund the instrumental public sector entities responsible for executing the plan. The preamble justifies the measure based on the need to ensure “effective and agile” execution and recalls that the DANA emergency “has not been exhausted.”

The decree-law was signed in Alicante on October 30, 2026, by the president of the Generalitat, Juan Francisco Pérez Llorca, along with the first vice-president and counselor for Housing, Employment, Youth and Equality, Susana Camarero Benítez, and the counselors José Antonio Rovira Jover (Economy, Finance and Public Administration), Juan Carlos Valderrama Zurián (Emergencies and Interior) and Marian Cano García (Industry, Tourism, Innovation and Trade).

Impact for thousands of beneficiaries

The regulation neutralizes the risk of having to return grants received on an urgent basis and relieves those already facing a reimbursement proceeding of the burden of interest, while providing managing bodies with a homogeneous framework for verification, settlement, and collection. For the regional accounts, it entails waiving public law revenues already settled and, with the expansion of credits for the “Endavant” plan, enables additional budgetary allocations without the need to process modifications every time the reconstruction requires it.
