The Consell approves the selection and mobility regulations of the Generalitat

The Consell has approved Decree 136/2026, of September 18, which approves the new Regulation for the selection, mobility, and provision of job positions within the Administration of the Generalitat. The regulation is published in the Official Gazette of the Generalitat Valenciana (DOGV) number 10458, of September 24, 2026, within section I of general provisions, and enters into force the day following its publication, that is, September 25. The text repeals Decree 3/2017, of January 13, which regulated this matter until now.

The regulation develops Law 4/2021, of April 16, on the Valencian Public Service (LFPV), whose third final provision empowers the Consell to issue the necessary regulatory provisions. The regulation was negotiated with union representation in accordance with article 37 of Royal Legislative Decree 5/2015 and article 188 of the LFPV, and responds to the commitment acquired in the Agreement of April 25, 2024, of the General Negotiation Table (MGN I), ratified by the Agreement of May 7, 2024, of the Consell. It is included in the 2025 Annual Regulatory Plan, approved on May 20, 2025.

The text consists of 112 articles distributed across seven titles, in addition to a preamble, five additional provisions, two transitional provisions, one repealing provision, two final provisions, and an annex. It is signed by the president of the Generalitat, Juan Francisco Pérez Llorca, and the counselor of Economy, Finance, and Public Administration, José Antonio Rovira Jover.

Selection: preferential competitive examination and 10% quota for people with disabilities

Title II regulates personnel selection. The competitive examination (oposición) will be ordinary and preferential, with at least 50% of the positions in the annual public employment offer reserved for this system, while internal promotion will be reserved a percentage not less than 40% of the vacancies announced for competitive examination or competitive merit-based examination (concurso-oposición).

Regarding disability, a quota of not less than 10% of the vacancies is reserved for people with a recognized degree equal to or greater than 33%, so that at least 3% of the total workforce is reached. Independent and specific calls are planned for people with intellectual disabilities, with tests of a fundamentally practical nature.

The main novelty is the Permanent Selection Commission, a specialized and permanent body attached to the general directorate competent in public service, consisting of a minimum of seven members, which will assume the evaluation of entry processes for the superior administration body (A1-01), the management body (A2-01), the administrative body (C1-01), and the auxiliary body (C2-01). The technical selection bodies (OTS) will be composed of an odd number of members, never fewer than five titular members with their substitutes, and their appointments will be published at least one month in advance.

Provision and mobility: competitions, free appointment and service commissions

Title III, the most extensive, regulates definitive provision through ordinary or specific competitions and free appointment, as well as temporary forms of provision. The resolution of the competitions must be issued within a maximum period of six months from the publication of the call, extendable by up to three more months.

  • Ordinary service commission: maximum stay of two years in vacant positions without legal reserve.
  • Service commission in free appointment positions: maximum of six months or until the resolution of the call.
  • Service commission for projects and special functions: maximum duration of one year, extendable for another year.
  • Commissions in international cooperation missions or programs: period not exceeding six months, unless the remuneration is borne by the Generalitat.

Health, temporary employment pools and forced mobility

The change of position for reasons of health, disability, or rehabilitation—whether one’s own or that of a spouse, domestic partner, or first-degree dependent relatives—is regulated. Assignment requires that the distance between the workplace and the health center exceeds 50 kilometers and that the estimated rehabilitation be equal to or greater than three months, with a maximum duration of one year, extendable.

Temporary employment pools will be established linked to public employment offers, with electronic registration within ten business days. The annex sets the scale for temporary forced mobility: up to 15 points for the care of children under 12 or younger and 0.05 points for each full month of active service, with a maximum of 10 points for seniority.

The regulation also creates the Disability Study Commission, with a presidency and six memberships, and provides for its supplementary application to public universities and local administrations of the Valencian Community.

A unique framework for the entire Valencian public workforce

The regulation affects all civil service and contractual staff of the Administration of the Generalitat, its public bodies and attached consortia, as well as candidates participating in selective processes. Procedures already initiated prior to its entry into force will continue to be governed by the regulations in effect on the date of publication of their call for applications, according to the first transitional provision.
