The BOME summons interested parties in the lawsuit for the payment of an employee's remuneration
Por FactBox Admin

The Ministry of Presidency, Public Administration and Equality of the Autonomous City of Melilla has summoned all potential interested parties in summary proceeding 116/2026, a contentious-administrative appeal regarding “Payment of Remuneration Concept.” The announcement, registered under number 1218, is published in the Official Gazette of the Autonomous City of Melilla (BOME) No. 6428, corresponding to Tuesday, November 3, 2026, on page 5377. Interested parties have a period of nine days to appear before the Court of First Instance, Contentious-Administrative Section, Plaza nº 2 of Melilla.
A nine-day period to appear as a defendant
The document states that summary proceeding 116/2026 was initiated at the request of Mr. Ramón Ruiz Torre and that, at the request of the appellant himself, it is brought to the attention of anyone who may have an interest in the matter. The summons allows them to appear as defendants, if applicable, and in defense of their interests before said Court.
The procedure complies with the provisions of the Law of Contentious-Administrative Jurisdiction, and the announcement is expressly published to comply with Article 49 of that regulation. It is, therefore, an official communication addressed to third parties who could be affected by the judicial resolution.
The document is dated Melilla, October 28, 2026, and is signed by the Technical Secretary of Public Administration, Francisco José Rubio Soler, with the official reference BOME-A-2026-1218.
Remuneration and shift work: two lawsuits on the same day
BOME No. 6428 includes two consecutive contentious-administrative summons in its Section I, both processed before the same judicial section of Plaza nº 2 of Melilla:
- Announcement 1217, summary proceeding 90/2026, at the request of Mr. Francisco Jiménez García, under the heading “Full Recognition of Shift Work.”
- Announcement 1218, summary proceeding 116/2026, at the request of Mr. Ramón Ruiz Torre, under the heading “Payment of Remuneration Concept.”
- In the case of 90/2026, a hearing is scheduled: December 2, 2026, at 10:00 AM, in Courtroom 10 of the Courts. The announcement for 116/2026 does not include a hearing date.
Both files concern remuneration and working hours for personnel in the service of the Autonomous City of Melilla, and both employ the same nine-day summons formula.
The background of the regularization of the special working day
The immediate context of these lawsuits is the regularization of special working day modalities in local administration. On July 9, 2026, the Governing Council approved the agreement registered under number 2026000656 and published via Order No. 0656 in BOME No. 6399, dated July 24, 2026, which classifies positions subject to shift work, night shifts, split shifts, Monday-to-Saturday or Sunday service, and on-call duties.
That text was subsequently corrected. On September 18, 2026, the Governing Council adopted agreement 2026000795 to rectify an error by omission: the provision of the technical report on the working day regime for non-permanent staff had not been incorporated into the published text. The rectification was published in BOME No. 6420, dated October 6, 2026.
The origin of the conflict lies in the writing of the UGT Trade Union Section, which demanded the inclusion of said non-permanent staff, mentioning areas such as Festivities, Bullring, and General Warehouse, and guaranteeing the recognition of remuneration when services are provided in positions subject to shift work, night shifts, holidays, or special working days. The prior nature of those pronouncements does not allow it to be affirmed that procedure 116/2026 is a direct result of them, but it does place the litigation within an open remunerative debate in the city.
Why it matters
The publication of this summons opens the door for other municipal employees in equivalent situations to appear in the lawsuit and defend their interests before the Court resolves the matter. The deadline is short—nine days from publication—so any worker of the Autonomous City of Melilla who considers themselves affected by the payment of remunerative concepts must act swiftly to avoid being left out of the procedure.
