El Berrueco regula los puntos de recarga eléctricos y su régimen sancionador

The El Berrueco City Council has published the municipal ordinance regulating the use, management, and operation of municipal electric vehicle charging points, which incorporates a sanctioning regime with fines of up to 750 euros. The full text appears in the Official Gazette of the Community of Madrid number 246, dated October 15, 2026, section III (Local Administration), with the reference BOCM-20261015-63. The regulation will enter into force once definitively approved and after the legally established period from its publication has elapsed.

The agreement was initially adopted by the Plenary of the El Berrueco City Council in the session of July 23, 2026, and published in BOCM number 189, dated August 10, 2026. As no claims or suggestions were submitted during the public information period, the agreement is understood to be definitively adopted in accordance with article 49.c) of Law 7/1985, of April 2, Regulating the Bases of the Local Regime. The announcement is dated October 5, 2026, and is signed by the mayor, Jaime Sanz Lozano.

The ordinance is issued under municipal competencies in urban environment, road infrastructure, traffic, vehicle parking, mobility, and management of municipal assets. The service may be provided through direct or indirect management, but the City Council will in all cases retain the powers of direction, inspection, control, and sanction. The economic regulation refers to the specific ordinance on the public price for the provision of the municipal charging service.

Four hours of maximum use and authorized vehicles

The regulation details which vehicles may connect, how long they may occupy the space, and which behaviors are prohibited:

  • Authorized vehicles: pure electric cars, plug-in hybrid cars, extended-range electric vehicles, electric motorcycles and mopeds, electric quadricycles, and electric or plug-in hybrid light commercial vehicles.
  • Electric bicycles and personal mobility vehicles only if the point is technically suitable and expressly authorized.
  • General maximum time of occupation and use: four hours, unless the signage, the management platform, or a municipal resolution sets another limit.
  • Prohibitions: occupying the space without effective charging, exceeding the authorized time, tampering with the installation, using unauthorized adapters or extension cords, disconnecting third-party vehicles, or making fraudulent use of the service.

The user must verify the compatibility of the vehicle, connect and disconnect according to the technical instructions, remove the vehicle upon completion of charging, and be liable for damages caused by incorrect, negligent, or fraudulent use.

Fines of up to 750 euros and vehicle removal

Title IV defines the infractions and sets the amounts, with the Mayor’s Office as the competent body for sanctioning:

  • Minor infractions: up to 100 euros, including failure to remove the vehicle within thirty minutes following the end of the recharge.
  • Serious infractions: from 101 to 300 euros, such as keeping the vehicle parked for more than one hour after recharging, causing damage through negligence, or repeating two minor offenses within a year.
  • Very serious infractions: from 301 to 750 euros, such as intentionally damaging the installation, stealing cables or connectors, tampering with measurement or payment systems, or causing situations of serious risk.
  • Very serious infractions may entail a temporary ban on the use of the service for a maximum period of three months.

The improper occupation of a reserved space may lead to the removal or immobilization of the vehicle, with the costs of transport, deposit, and custody borne by the responsible person. The vehicle owner shall be obliged to truthfully identify the responsible party when requested.

A single charging point in Annex I

The first additional provision incorporates as Annex I the initial list of municipal installations, updatable by resolution of the Mayor’s Office:

  • Location: Av. de España, 1C, 28192 El Berrueco (Madrid).
  • Associated spaces: 2.
  • Maximum power: 22+22 kW, with Type 2 connector.
  • Hours: 24 hours, with a maximum usage time of 4 hours between 7:00 and 22:00.
  • Access method: Android App, iOS App, Web, and RFID card.
  • Economic regime: subject to public pricing.

The text also regulates the data protection of users, the channels for complaints and claims, and public information regarding the location, hours, and incidents of the points.

The ordinance provides the municipality with a stable framework to organize electric mobility on municipal land and prevents the misuse of spaces that until now lacked specific regulation. Against the agreement, which ends the administrative route, a contentious-administrative appeal may be filed before the Contentious-Administrative Chamber of the High Court of Justice of Madrid within two months from the day following the publication of the announcement.
