Education sets minimum services for the SINDI-K strike

The Department of Education of the Regional Government of Castilla y León has established the essential services and minimum staffing levels to guarantee student care during the strike called by the National Independent Union for Development and Innovation (SINDI-K) on September 24 and 25, 2026. This measure is detailed in Order EDU/922/2026, of September 21, published in the Official Gazette of Castilla y León no. 184, of September 22, 2026 (reference BOCYL-D-22092026-184-21). The regulation affects public educational centers and non-university educational system support services dependent on the Department.

Legal Framework and Prior Negotiation

The order is based on Article 28 of the Spanish Constitution, which recognizes the right to strike, and section 28.2, which allows for the agreement of measures to guarantee the operation of the community’s essential services. It also invokes Royal Decree-Law 17/1977, of March 4, on labor relations; articles 15.c) and 95.2.m) of the recast text of the Law of the Basic Statute of the Public Employee, approved by Royal Legislative Decree 5/2015, of October 30; and article 7.2.v) of Law 7/2005, of May 24, on the Public Service of Castilla y León.

The text is issued following negotiation with the strike committee and in the exercise of the competence delegated by Order PAT/384/2006, of March 10. The Department emphasizes that the right to strike is not absolute and must be balanced with the general interest and the fundamental right to education set forth in Article 27 of the Constitution.

Presence of Management Teams

The annex establishes as a minimum service the presence in centers of part of their single-person governing bodies. In general:

The director, who will guarantee the proper functioning of the school day and facilitate the attendance of those who voluntarily wish to attend.
The head of studies or, where applicable, the secretary, who will remain at the center performing their respective functions.
The teacher providing services in single-unit centers.
In Grouped Rural Schools and Compulsory Education Centers with scope localities: in the main center, the director and head of studies or secretary; in the remaining localities, one teacher.

Reinforcements in Residences, Special Education, and CRIE

Given the specificity of the services provided in Special Education Centers, Residences, CRIE (Resource Centers for Educational Innovation), and Home Schools, minimum services are increased with provincial distribution:

Ávila: four teachers at the C.E.E. «Príncipe Don Juan».
Burgos: one primary support teacher and another for secondary in the afternoon and night shifts at the Escuela Hogar «Santa María La Mayor» in Fuentes Blancas, and one teacher at the CRIE of Burgos.
León: one support teacher in the afternoon and night shifts at the Residencia del IES «Astúrica Augusta».
Salamanca: one support teacher in the afternoon and night shifts at the Escuela Hogar «Los Sitios» in Ciudad Rodrigo and at the residences of the CIFP «Rodríguez Fabrés» and the IES «Fernando de Rojas».
Segovia: three morning support teachers and one for the afternoon at the C.E.E. «Ntra. Sra. de la Esperanza», and two teachers at the CRIE of Fuentepelayo.
Soria: residence managers in the indicated shifts at the CEE Santa Isabel, the IES Politécnico, the IES «Ribera de Jalón» in Arcos de Jalón, the IES «La Rambla» in San Esteban de Gormaz, and the IES «Margarita de Fuenmayor» in Ágreda; additionally, one support teacher in the morning, afternoon, and night shifts at the CRIE of Navaleno, Almazán, and Berlanga de Duero.
Zamora: one support teacher per shift at the residences of the IES «Universidad Laboral» and the IES «Alfonso IX», and at the Escuela Hogar «Río Duero».

Designation, effects, and appeals

The designation of the individuals who must provide minimum services corresponds to the Director General of Education Professionals. The order warns that the established essential services may not be disrupted by disturbances or strikes by the designated personnel, and those who cause such disruptions will incur liability in accordance with current legal regulations.

The regulation takes effect from the day of its publication in the bulletin. An optional appeal for reversal may be filed before the Counselor of the Presidency, or a contentious-administrative appeal before the Contentious-Administrative Chamber of the High Court of Justice of Castilla y León within two months, counting from the day following its publication. The decision directly affects families and students throughout the community, who for two school days will have reduced access to management staff and the planned reinforcements in residences and specific centers. For the teaching staff, the order delimits which positions are required to remain at the center and reminds them that the remunerative effects of the strike are governed by current regulations.
