Economy imposes definitive antidumping duty of 0.3918 dollars on US PVC
Por FactBox Admin

The Ministry of Economy declared the conclusion of the antidumping proceeding regarding imports of suspension PVC originating from the United States and imposed a definitive countervailing duty of 0.3918 dollars per kilogram, lower than the provisional duty of 0.6315 dollars. The measure was recorded in the final Resolution published in the Official Gazette of the Federation on October 28, 2026 (publication 295/2026, p. 49) and enters into force the day following its publication.
Case file AD_36-24, filed in the International Trade Practices Unit of the Ministry of Economy, began with the request submitted on December 10, 2024, by Mexichem Resinas Vinílicas, S.A. de C.V., the sole national producer of the resin. The proceeding was formally initiated via a resolution published in the DOF on April 28, 2025, with an investigated period from October 1, 2023, to September 30, 2024, and a damage analysis period from October 1, 2021, to September 30, 2024.
The preliminary stage, published on March 24, 2026, had imposed a provisional duty equivalent to the price discrimination margin calculated at that time. The final resolution was signed in Mexico City on October 19, 2026, by the Secretary of Economy, Marcelo Luis Ebrard Casaubon.
Scope of the duty and immediate effects
The duty applies to imports entering under tariff heading 3904.10.03 of the TIGIE, NICO 00, or any other, regardless of the country of origin. It will be charged in dollars per kilogram and settled in its equivalent in national currency; it is the responsibility of the Ministry of Finance and Public Credit to apply it throughout the territory.
- It is ordered to cancel the guarantees established by the provisional duty and return, with interest, the amounts paid for the difference.
- Importers will not pay the duty if they prove that the country of origin is other than the United States, in accordance with the agreement on the determination of the country of origin published in the DOF on August 30, 1994, and its amendments.
- The resolution will be notified to the parties and communicated to ANAM and the SAT; the case is archived as totally and definitively concluded.
The investigated product is the vinyl chloride monomer homopolymer obtained by suspension polymerization, with a K value from 48.5 to 99. Bulk PVC, emulsion or microsuspension PVC, and mixtures with additives or dry-blend are excluded.
From the dumping margin to the non-injurious price
The Ministry of Economy determined price discrimination margins of 0.59 and 0.72 dollars per kilogram in the investigated imports. Based on Article 9.1 of the Anti-Dumping Agreement and Article 62 of the Foreign Trade Law, it evaluated applying a duty lower than the margin —the lesser duty rule— and took as a non-injurious price a break-even point where revenues cover the manufacturing cost with a reasonable profit.
The amount of 0.3918 dollars per kilogram is the one that, according to the resolution, would allow import prices to be brought to a non-injurious level and correct the damage. The agency rejected the arguments of importers and exporters regarding the infeasibility of alternative supply sources and the transmission of the duty to the processing sector, and maintained that the purpose of the measure is to restore fair competition conditions.
The damage that supported the measure
In the investigated period, U.S. imports represented 98% of total imports and 58.5% of apparent national consumption, compared to a market share of 40.3% for national production. The prices of the investigated imports fell 49% in the analyzed period and dragged down the national price by 50%.
- Production: −8%; national production oriented toward the domestic market: −5%; domestic sales: −3%; employment: −1%; productivity: −7%; capacity utilization: −6 percentage points.
- Operating margin: from 16.3% to −28.1%, a drop of 44.4 percentage points.
- Return on assets: from 21.7% to −5.3% between 2021 and 2023.
- Operating cash flow: −91.5% from 2021 to 2023.
The resolution ruled out that the drought in Tamaulipas, the drop in exports, imports from other origins, or the market structure were alternative causes of the damage, and concluded that imports under dumping conditions displaced national production.
Who appeared
In addition to Mexichem Resinas Vinílicas, the following participated in the procedure:
- Importers such as ADS Mexicana, Chemical Additives de México, Conductores Monterrey, Futura Industrial, Grupo Quimisor, Industrias Plásticas Internacionales (IPISA), Megaplast, PLAMI, Plásticos Ceccan, Royal Plastic Pipe, Sinteplast, Tuberías Advance del Caribe, and Westlake Compounds México.
- Exporters such as Formosa Plastics Corporation (Louisiana, Texas, and U.S.A.), Oxy Vinyls Export Sales, Oxy Vinyls, Shintech, Tricon Dry Chemicals, Westlake Corporation, Westlake Chemicals & Vinyls, Westlake Vinyls Company, and Westlake Vinyls.
- The United States Embassy in Mexico, which presented arguments and complementary evidence in the final stage.
The quota directly impacts the plastic processing sector—manufacturers of pipes, fittings, profiles, packaging films, cable coatings, and footwear—which must pay the new duty starting the day after publication, while the national industry remains protected by an amount lower than the calculated dumping margin and with the return of the provisional guarantees already established.
