Decree expropriates 14 hectares of the Matamoros ejido in favor of INSUS

Decreto expropia 14 hectáreas del ejido Matamoros a favor del INSUS

The President of the United Mexican States, Claudia Sheinbaum Pardo, issued the decree by which 14-03-56 hectares of common-use grazing lands of the Matamoros ejido, municipality of Matamoros, state of Coahuila de Zaragoza, are expropriated for reasons of public utility in favor of the National Institute of Sustainable Land (INSUS). The instrument was published in the Official Gazette of the Federation (DOF) on Friday, September 25, 2026, number 260/2026, page 6, within the Executive Branch section. The fixed compensation amounts to 1,602,818.64 pesos (one million six hundred two thousand eight hundred eighteen pesos 64/100 M.N.).

The decree is based on articles 27, first and second paragraphs, and 92 of the Political Constitution of the United Mexican States; 93, fraction V, and 94 of the Agrarian Law; 6, fraction IV, of the General Law of Human Settlements, Territorial Planning and Urban Development, and 60, 61, 73, 74, 75 and 76 of the Regulations of the Agrarian Law regarding the Planning of Rural Property. The administrative file was processed before the Secretariat of Agrarian, Territorial and Urban Development (Sedatu) under number 13844/INSUS, and the decree was signed on September 22, 2026, at the residence of the Federal Executive Power, with the rubric of Secretary Edna Elena Vega Rangel.

File 13844/INSUS and the rectification of the surface area

INSUS, through official letter number 1.0/040/2018 dated March 23, 2018, requested the then head of Sedatu for the expropriation of 14-03-70 hectares of the Matamoros ejido. On June 14, 2018, the then General Directorate of Rural Property, now the General Directorate of Presidential Resolutions and Expropriations (DGRPE), issued the agreement to initiate the procedure under file number 13844/INSUS.

Technical works modified the original figure:

  • The technical commissioner of the National Agrarian Registry (RAN) and the commissioner of Sedatu submitted the Commission Report on Technical and Informative Expropriation Works on July 2, 2025, which fixed the actual surface area at 14-03-56 hectares.
  • The General Directorate of Territorial and Urban Planning (DGOTU) updated the technical opinion DGOTAZR/DGAGO/0112/COAH/CORETT/0019/2016 on November 14, 2025, rectifying the surface area to 14-03-56 hectares.
  • The DGRPE issued the ruling on February 26, 2026, declaring the expropriation proceedable.

The ejido’s commissariat was notified on November 10, 2025, of the request, the initiation agreement, the actual surface area, and the valuation report, with a period of 10 business days to state whatever was in their interest; no statements were presented.

Destination of the lands and amount of compensation

The expropriated area will be used for its regularization and legal titling through the sale of the plots occupied by the residents, the sale of vacant lots to third parties who request a lot, as well as the donation of the areas necessary for equipment, infrastructure, and urban and municipal services in the area. The lands are distributed in two polygons:

  • Human Settlements Zone 1 “A”: 10-71-83 hectares, polygon I.
  • Human Settlements Zone 1 “B”: 03-31-73 hectares, polygon II.

The Institute of Administration and Appraisal of National Assets (Indaabin) issued on October 17, 2025, the valuation report with sequential number 02-25-676 and generic number G-43865-ZNB, which determined the indemnity amount of 1,602,818.64 pesos. It is the responsibility of INSUS to prove payment or cover it with its authorized budget, and Sedatu will execute the expropriation once payment has been proven.

Agrarian Background and Validity of the Decree

The Matamoros ejido was endowed by presidential resolution on November 26, 1936, with 12,386-00-00 hectares, executed on November 29, 1936, and divided by a resolution published in the DOF on October 21, 1971, which assigned it 3,017-00-00 hectares. It was registered in the Registry and History of Agrarian Nuclei of the RAN on June 21, 1995, with folio 05017011124111936R. The general assembly of ejidatarios on September 22, 2015, ratified on June 30, 2017, granted its consent to the expropriation process.

The ejido records five previous expropriations: 182-27-06 hectares (1989), 64-75-66 (1991), 17-36-48.25 (1993), 34-02-80 (1994), and 5-70-30 hectares (2008). The decree enters into force and takes effect on the day of its publication, and orders its registration in the RAN, the Federal Public Registry of Property, and the state or municipal public property registry. If the assets are used for a different purpose or the cause of public utility is not fulfilled within five years, the National Ejidal Development Fund Trust may claim reversion in accordance with Article 97 of the Agrarian Law.

The measure is framed within commitment number 49 of the National Development Plan 2025-2030, the “Massive house titling program,” and provides legal certainty to possessors and ejidatarios of the irregular settlement by incorporating the area into urban development and public services.
