The Official Gazette published on Wednesday, September 30, 2026, Decree No. 75 of the Ministry of Labor and Social Security, which approves the regulation for the execution of Law No. 21,808, creating a new Unified Employment Subsidy System. The regulation, disseminated in Bulletin No. 44,562 (CVE 2880088), comes into effect on October 1, 2026, and its administration is the responsibility of the National Training and Employment Service (Sence).
The decree was signed on June 24, 2026, by the President of the Republic, José Antonio Kast Rist, along with the Minister of Labor and Social Security, Tomás Rau Binder, and the Minister of Finance, Jorge Quiroz Castro. The Comptroller General of the Republic processed the document with a scope of application via official letter No. OF184153/2026, dated September 29, 2026, specifying that the reference to Article 46 of Law No. 19,880 contained in Article 18 of the regulation must be understood as referring solely to the notification of the respective administrative acts.
The subsidy is a fiscally funded monetary benefit intended to promote decent work and formal employment, incentivizing the participation and hiring of the beneficiary persons contemplated by the law. The regulation details the application process, processing, determination, allocation, and payment of the contribution, the grounds for recalculation, and the reimbursement of undue payments.
Priority groups and access requirements
The text establishes four priority groups to access the benefit:
- Young people between 18 and 24 years, 11 months, and 30 days of age.
- Women between 25 and 54 years, 11 months, and 30 days of age.
- Persons aged 55 and over.
- Persons with disabilities registered in the National Disability Registry (RND), aged 18 and over.
Dependent workers must maintain a monthly gross income equal to or less than 2.25 IMM, prove at least 6 continuous months of unemployment or 8 discontinuous months within the 18 months prior to application, meet the current socioeconomic vulnerability level, and not have been convicted of misuse of the subsidy according to Article 467 of the Penal Code. Persons with disabilities registered in the RND are exempt from the vulnerability requirement.
Companies, meanwhile, must hire persons from the priority groups for twelve months, pay first-category taxes, be up to date with labor and social security obligations, apply within three months of the start of the employment relationship, and have no record of convictions for anti-union practices or recidivism in labor breaches.
Amounts, percentages, and duration
The contribution is equivalent to a percentage of up to 20% of the gross monthly remuneration. A percentage lower than 10% or higher than 20% cannot be set for companies and workers, and together they must reach 30% for the respective priority group. During the first year of the law’s validity, the percentage will be 20% for companies and 10% for workers.
- The reference Minimum Monthly Income (IMM) is $529,000, adjustable according to the variation of the Consumer Price Index, with the first adjustment in January 2027.
- The contribution to the worker may never be less than 2.5% of the IMM.
- The maximum duration is 12 months; it increases to 15 months for people with disabilities and for micro and small enterprises.
- Each company can receive the subsidy for a maximum of 200 workers.
- Monthly payments to dependent persons are provisional and equivalent to 90% of the amount, with a subsequent settlement.
Application, payments, and oversight
Applications are processed electronically through the Social Single Window (VUS), administered by the Ministry of Social Development and Family. Sence will establish more than one application period per calendar year and must publish them on its website at least 30 calendar days in advance.
Regarding payments, companies with 1 to 199 workers receive 50% of the installment in the first month, 75% in the second, 100% in the third, and from the fourth onwards, the full installment plus the remaining balance. Companies with 200 or more workers receive the first payment in the fourth month. The disbursement is made via bank transfer.
The Superintendency of Social Security exercises the supervision and oversight of Sence, which in turn must submit semi-annual reports to the Ministry of Labor and Social Security and to the Labor commissions of the Senate and the Chamber of Deputies. Those who provide false data to receive the subsidy will be sanctioned with the penalties of article 467 of the Penal Code, and the General Treasury of the Republic may withhold tax refunds to collect the amounts owed.
The regulation orders the transition from the old employment subsidies of laws No. 20,338, No. 20,595, and No. 20,255 toward the new system, with automatic application for those who meet the conditions at the time it comes into effect. For companies, the text provides certainty on how much the State will contribute for each hire and under what conditions; for workers, it defines for the first time the brackets, deadlines, and caps of a benefit that will be paid monthly and does not constitute income or remuneration for any legal purpose.
