Creixell approves civility ordinance with fines of up to 2,500 euros
Por FactBox Admin

The Creixell City Council has definitively approved the Municipal Ordinance on Civility and Citizen Coexistence, a regulation that establishes for all residents and visitors of the municipality a catalog of prohibited behaviors and the resulting sanctions regime. The full text is published in the Official Gazette of the Province of Tarragona on October 22, 2026 (reference CVE 2026-09560), after the initial plenary agreement received no claims during the public exhibition period.
The reference agreement is that of the Plenary Session of June 18, 2026, which initially approved the ordinance and is now automatically elevated to definitive status, in compliance with Article 178 of the Recast Text of the Municipal and Local Regime Law of Catalonia, approved by Legislative Decree 2/2003, of April 28, and Article 65 of the Regulation of Works, Activities, and Services of Local Entities, approved by Decree 179/1995, of June 13. The announcement is signed by the mayor, Montserrat Muñoz Madueño, dated October 13, 2026.
The new regulation replaces the Ordinance on Citizen Coexistence in Public Spaces approved in 2008. The preamble justifies the reform based on three factors: a more diverse and plural social reality, the detection of uncivil behaviors affecting collective quality of life, and the intense influx of visitors during the summer season, which increases pressure on public space and necessitates the protection of neighborhood rest.
A text of 53 articles structured into five titles
The ordinance consists of 53 articles, one transitional provision, and one final provision, organized into five titles:
- First Title (articles 1-11): general provisions, purpose, scope of application, rights and duties of citizens.
- Second Title (articles 12-24): behavior in public spaces, including fires and barbecues, popular festivals, gambling, substance consumption, unauthorized street vending, begging, domestic animals, and weapons.
- Third Title (articles 25-35): use of public goods and services, municipal heritage, parks and gardens, fountains, waste and street cleaning, abandoned vehicles.
- Fourth Title (articles 36-42): visual, atmospheric, and acoustic pollution, with rules for good neighborliness and noise limits for establishments.
- Fifth Title (articles 43-53): sanctioning regime, infractions, sanctions, responsibilities, and reparation of damages.
The scope of application covers the entire municipal district, including the beaches of Creixell, and extends to spaces, facilities, and assets of private ownership when the behaviors carried out therein affect coexistence in the public space.
Three degrees of infraction and fines of up to 2,500 euros
Article 50 establishes the following amounts:
- Minor infractions: fine of up to 500 euros.
- Serious infractions: fine from 500.01 to 1,000 euros.
- Very serious infractions: fine from 1,000.01 to 2,500 euros.
Among minor behaviors are littering on public roads, producing disturbing noises during nighttime rest hours, failing to respect park schedules, or the inappropriate use of urban furniture. Serious offenses include consuming alcohol on public roads when it disrupts coexistence, graffiti and paintings, abandoning furniture in the street, exceeding noise limits, or recidivism in minor offenses within one year. Very serious offenses are gambling with money in public spaces, burning containers or trash cans, cutting down trees, camping without authorization when it seriously disrupts coexistence, and recidivism in serious offenses.
The admission of responsibility by the offending person reduces the amount of the proposed sanction by 30%. Offenses expire after three years (very serious), two years (serious), and six months (minor); sanctions expire after three, two, and one year, respectively.
The Mayor’s Office instructs the files and the ordinance arrives with a fifteen-day margin
The competence to initiate sanctioning proceedings and impose sanctions corresponds to the Mayor’s Office or the department to which it is delegated, according to article 44. The procedure complies with Law 39/2015 and Law 40/2015, and those responsible are obliged, in addition to paying the fine, to replace and restore the altered physical reality and to compensate for the damages caused.
The transitional provision maintains the previous regulations for files initiated for acts committed before the entry into force, unless the new ordinance is more favorable. The final provision establishes that the text will enter into force once published in full in the provincial bulletin and after fifteen business days have elapsed, in accordance with article 65.2 of Law 7/1985. An administrative-law appeal may be filed against the agreement before the Administrative Litigation Chamber of the High Court of Justice of Catalonia within a period of two months.
The regulation arrives with the municipality already in the low season, but it will deploy its full effects before the next summer, the period in which the council places the greatest pressure on public space. For residents, the main change is that daily behaviors—noise, waste, alcohol in the street, use of parks and beaches—now have a typified and quantified sanctioning response, with the Mayor’s Office as the decision-making body.
