Supreme Court reinstates three notaries after their suspensions end
Por FactBox Admin

The Supreme Court of Justice declared the suspensions imposed on three notaries in the exercise of the public function of the notary ended and ordered their re-inclusion in the permanent roster of notaries. The decision is contained in Agreements Nos. 1661-D, 1870-D, and 1874-D, issued by the General Secretariat of the court and published in the Official Gazette, Volume No. 452, Number 176, of Wednesday, September 23, 2026, on page 15.
The agreements were signed by Ms. Julia del Cid, General Secretary of the Supreme Court of Justice, in exercise of the delegation conferred by the Plenary through Agreement 7-P of October 17, 2019. The publication is based on articles 24 and 43 of the Administrative Procedures Law, article 70, obligation 13a, of the Judicial Organic Law, articles 14 and 182, attribution 12a, of the Constitution of the Republic, and article 13 of the Notary Law.
The three reinstated notaries
Each resolution corresponds to a different disciplinary file and sets its own effective date:
- Linda Aracely Amaya Martínez: file D-2439-23 (D-012-AL-23); Plenary resolution of July 14, 2026; sanction started on August 15, 2024, and applied by Agreement 2001-D of September 12, 2024; effective from August 11, 2026; Registration No. F48333.
- Jorge Daniel Barraza: file D-2649-23 (D-009-BJ-23); Plenary resolution of July 23, 2026; sanction started on May 20, 2025, and applied by Agreement 1283-D of July 1, 2025; effective from September 10, 2026; Registration No. C8713.
- José Yovany Ayala Pacas: file D-1162-23 (D-018-AJ-23); Plenary resolution of August 20, 2026; sanction started on May 24, 2024, and applied by Agreement 1426-D of July 3, 2024; effective from September 10, 2026; Registration No. F48264.
In all three cases, the agreement expressly provides to “include the name” of the professional in the permanent roster of notaries, thereby formally closing the suspension period.
Scope of the decision
The agreements were issued “for the purpose of executing the administrative acts inherent to the sanction dictated in the administrative sanctioning processes.” That is, the General Secretariat communicates the full compliance of the sanction and executes the effect provided by law for its extinction: the return of the notary to the full exercise of their functions.
The resolution of each case was adopted by the Full Court on different dates—July 14, July 23, and August 20, 2026—while the official communication was issued on August 11 and September 10, 2026. The effective dates also differ: that of Linda Aracely Amaya Martínez is effective from August 11, and those of Jorge Daniel Barraza and José Yovany Ayala Pacas from September 10 of the current year.
Notification to courts and registries
The three agreements order the issuance of an official letter informing all courts and public registries in the country, in addition to publication in the Official Gazette under the formula “Let it be known.” The Summary of the same issue includes the block under the heading “Agreements Nos. 1661-D, 1870-D, and 1874-D.- Suspensions imposed on the exercise of the public function of the notary are declared terminated,” within the Judicial Branch section.
The notification to the registries is decisive because it determines whether the notarial acts that these professionals authorize once again are admitted into legal traffic and into the registration books.
Impact for readers
The reinstatement restores public faith to three notaries and restores their capacity to authorize deeds, testimonies, and acts with full validity before third parties and the State. For the citizenry, it means that instruments granted before them from the indicated effective dates regain registration support, and for the public registries, the mandatory update of their lists of authorized notaries.
