Copenhagen court serves bankruptcy ban writ publicly against absent defendant

Sø- og Handelsretten in Copenhagen has received a writ in the bankruptcy-ban case BS-15710/2026-SHR, brought by the bankrupt estate of YMD Trading ApS against Ahmed Ibrahim Hussein Kassab, whose address is unknown. Because a second attempt at service of process has not been possible, the notice is served publicly in Statstidende on 8 October 2026, and the defendant has four weeks from publication to submit a statement of defence.

The announcement was issued by Sø- og Handelsretten on 6 October 2026 and appears in the gazette’s section for writs and summonses concerning persons and companies, under message number S06102026-47. Statstidende is Denmark’s official gazette for legal announcements, and public service through it is used when a party cannot be reached by other means; the court states expressly that it has been unable to make contact with the defendant.

Public service and the four-week deadline

  • The notice is served publicly because other service has not been possible.
  • The writ and its annexes may be obtained from Sø- og Handelsretten, Amaliegade 35, 2. sal, 1256 København K, telephone 9968 4600.
  • A statement of defence must be sent within four weeks of the announcement to civil@shret.dk.
  • The reply must also state an address that can be used for future contact with the defendant.

The four-week period runs from the publication of the announcement itself, not from the date the writ was issued. Once the notice has been published, the case can proceed on the basis of public service even though the defendant has not been reached in person.

The parties and the case

  • Case reference: BS-15710/2026-SHR.
  • Claimant: YMD Trading ApS under konkurs, the estate of a company declared bankrupt.
  • Defendant: Ahmed Ibrahim Hussein Kassab, whose address is unknown.
  • Issuing court: Sø- og Handelsretten, Denmark’s specialised court for maritime and commercial matters, sitting in Copenhagen.
  • Date of the court’s notice: 6 October 2026.

The case is a bankruptcy-ban action, a procedure in which a court decides whether a person should be barred from managing a business after involvement in a bankruptcy. The notice does not state the grounds relied on or the length of any ban sought; it records only that the writ has been received and that the defendant has been summoned to answer it.

What a bankruptcy ban involves

The notice directs readers to the court’s website for further information on what a bankruptcy ban entails and on the rules in konkurslovens §§ 162, 163 and § 164, stk. 2. Under the general framework set out in the same edition of Statstidende, a person subject to a bankruptcy ban may not take part in the management of a business for up to five years without bearing personal and unlimited liability for its obligations, and is entered in Erhvervsstyrelsen’s register of persons subject to such a ban.

The same framework provides that a ban is not itself served on the person concerned, and that a ruling imposing one becomes available through the Danish court portal. Information in the register may be disclosed to the courts, the police and the prosecution service.

For readers, the publication marks the point at which the case can move forward without the defendant having been reached in person. If no statement of defence is filed within the four-week period, the proceedings continue on the basis of the writ as served, and any ban subsequently imposed would be recorded in the public register, restricting the person’s ability to serve as a manager of a Danish company.
