Consell: urgent expropriation of properties for road safety on the CV-35
Por FactBox Admin

The Consell has declared the urgent occupation of the assets and rights subject to compulsory expropriation to execute the works of the project for the “Improvement of road safety between PK 4+100 and 15+800 of the CV-35”, in the municipal terms of Burjassot, Paterna, and San Antonio de Benagéber. The agreement was adopted on October 30, 2026, and is signed by the counselor secretary José Luis Díez Climent. It is published in the Official Gazette of the Generalitat Valenciana (DOGV) number 10485, of November 3, 2026, with the official reference DOGV-C-2026-33725.
The declaration is based on Article 52 of the Compulsory Expropriation Law of December 16, 1954, and Article 56 of its Regulations, and comes after the Directorate General of Land Transport Infrastructure definitively approved the project on June 1, 2026, a procedure that already entailed the declaration of public utility and the need for occupation according to Law 6/1991 on roads of the Comunitat Valenciana. The Consell maintains that the urgency derives from the need to curb rear-end collisions on a road with very high traffic intensities and to execute the work “with the greatest speed.” The expropriating administration is the Generalitat Valenciana, through the Third Vice-Presidency and Department of Environment, Infrastructure, Territory and Recovery, and the beneficiary entity is Autovía del Turia Sociedad Concesionaria de la Generalitat Valenciana, SA (AUTURSA).
Eighteen properties and 32,116 euros in compensation
The annex of the agreement identifies 18 properties: eleven in Paterna and seven in San Antonio de Benagéber. Sixteen of them are expropriated in full and total 7,602.82 square meters; the other two (properties 10 and 11, in Paterna) are only burdened with an aerial right-of-way easement of 55 and 40 square meters respectively. The affected uses are pastures, citrus groves and carob trees (irrigated and dryland), and arable land or tillage.
Among the owners are:
- La Industrial Levantina de Cafés Durban, SL, with 312.7 m² in Paterna.
- Coinfer SC, with two plots totaling 636.74 m².
- Nebifa2003, SL, Gimeno Gómez-Zurdo, Oliver, Roig Peris, Carmen, and Falco Alfonso, Salvador.
- The heirs of Viguer Cebria, José, Alfaro Palomares, Eduardo, Andrés Ferriol, Enrique, Bonet Pérez, José Joaquín, and Roig Castello, Milagros.
- The brothers Pascual Ribes, Vicente, José, Ramón, and Manuel, and the siblings Pérez Salón, María Carmen, José Dionisio, and Salvador.
- Masía de Sorrulla, SA, Pons García, Luis, and the six owners of property 15, including Sorli Soriano, Vicente and Roig Giner, Milagro Carmen.
The payment for the expropriations amounts to 32,116.38 euros and does not create a budgetary commitment for the Generalitat: it is assumed entirely by the concessionaire, which maintains guarantees for 3,315,219.35 euros with the Deposit and Bond Fund (Caja de Depósitos y Fianzas).
Four conflict points and up to 125,896 vehicles per day
The project acts on four accident concentration sections (TCA):
- Point 1: surroundings of PK 4+000, “Exit 4”, in Burjassot.
- Point 2: PK 10+000, collector road towards València, “Exit 10”, in Paterna.
- Point 3: PK 11+000, main trunk towards València, “Exit 11”, in Paterna.
- Point 4: PK 16+000, main trunk towards Llíria/Ademuz, “Exit 16”, in San Antonio de Benagéber.
The works provide for weaving lanes at exits 4, 11, and 16, doubling the section of the collector road at exit 10, and a new link branch at exit 16 to decongest the roundabout. The average daily traffic in 2025 was 125,896 vehicles between PK 8+500 and 12+500, 116,689 between PK 2+500 and 5+500, and 97,869 between PK 13+500 and 17+000. The material execution budget is 6,692,691.04 euros, and the base tender budget including VAT reaches 9,636,805.83 euros.
Concession since 2005 and administrative calendar
The concession contract for the renovation, conservation, and operation of the CV-35 was formalized on September 12, 2005. The expropriation file is 2026-2 and its processing included:
- October 2024: the Conselleria commissions the preliminary studies and the project.
- June 9, 2025: AUTURSA requests the contractual modification for the additional works.
- November 9, 2025: provisional approval of the project and public exhibition for 30 business days.
- December 22, 2025: announcement in the DOGV number 10266 and dissemination in Las Provincias and Levante.
- April 10, 2026: closing of the objections process; July 27, 2026: public information of the list of assets in the DOGV number 10414, with no objections.
Objections and appeals
Following publication, interested parties may file written objections with the expropriating administration solely to correct errors in the list of assets, until the drawing up of the preliminary record. Against the agreement, which exhausts the administrative route, a contentious-administrative appeal may be filed before the Contentious-Administrative Chamber of the High Court of Justice of the Valencian Community within two months, or optionally a motion for reconsideration within one month, provided that both are not pursued simultaneously.
The decision unlocks the immediate occupation of the land and brings forward works that affect thousands of daily drivers from L’Horta Nord and El Camp de Túria, the main connection route between València and the interior of the province.
