The Corporate Honor Tribunal of the Federated College of Engineers and Architects of Costa Rica (CFIA) has summoned the company Ferro y Asociados Diseño y Construcción S. A. and its responsible professional, Arch. Adriana Ferro Gámez, to an oral and private hearing for alleged faults in the construction management of a residence in San Carlos. The appearance will take place on Thursday, November 5, 2026, in annex house four of the CFIA Building, in Curridabat, according to the edict published for the second time in La Gaceta No. 183 on Tuesday, September 29, 2026 (reference IN202601129087).
The origin: a complaint regarding an unfinished home
The process is being handled under case file No. 0531-2025, opened following the complaint filed on December 12, 2024, by the owner Gilda Chinchilla Rojas and her legal representative, Lic. Luis Dobles Ramírez. The preliminary investigation was undertaken by the Analysis and Verification Center of the CFIA, whose report No. 0408-2026-CAV, dated May 26, 2026, was fully adopted by the General Board of Directors through agreement No. 25 of session No. 24-24/25-G.E., on June 2, 2026.
The case revolves around consultancy contract OC-1068511, registered with the CFIA on December 7, 2022, for the construction of a 56 m² residence in the district of Quesada, canton of San Carlos, province of Alajuela, with cadastral plan A431984-1997. The company was registered as responsible for preliminary studies, preliminary project, plans and technical specifications, and construction management, the latter service provided between December 7, 2022, and May 20, 2024.
The attributed charges
The summons order INT-102-2026/0531-2025, signed on August 13, 2026, details three facts:
- Failing to warn the client about the difficulties in completing the delivery of prefabricated materials, despite the fact that the responsible professional was simultaneously the legal representative of the supplier Industria de Estructuras Prefabricadas IDEPSA S. A. (CC-09975).
- Failing to exercise control over the scheduling and progress of the project or to prepare periodic reports, as the work remained halted and unfinished between June 8, 2023, and May 20, 2024.
- Failing to ensure that observations, orders, and incidents of the work were recorded in the digital logbook with a maximum periodicity of seven calendar days.
The conducts could contravene the Organic Law of the CFIA, Law No. 3663 of January 10, 1966, and its Article 59, as well as the General Internal Regulations of the CFIA, the Regulations for the Contracting of Engineering and Architecture Consulting Services, the Company Regulations, the Special Regulations of the Digital Logbook for Project Control, and the Code of Professional Ethics.
Tribunal, deadlines, and financial scope
The Honor Tribunal is composed of:
- Eng. Daniel Guzmán Ovares, president.
- Arch. Ricardo Fliman Wurgaft, secretary.
- Eng. Mario Chavarría Gutiérrez, coordinator.
- Eng. Javier Chacón Hernández, acting executive director.
The company Ferro y Asociados Diseño y Construcción S. A., registration CC-08251 and legal entity ID 3-101-300489, has a non-extendable period of 21 business days to respond in writing to the facts. The resolution may be challenged by a motion for reconsideration with a subsidiary appeal within a period of seven business days. The procedure is governed by the CFIA Regulations Regulating the Procedures for the Application of Professional Ethics and its Financial Effects, a norm that provides for ethical and financial sanctions.
The hearing of November 5
During the appearance, all evidence offered by the parties will be admitted and received, the documentary evidence from the file will be processed, and the statements of the parties and witnesses, as well as the final closing arguments, will be heard. Only the parties, their legal representatives, lawyers, and witnesses may attend. Additional documentation must be sent to plataformadeservicios@cfia.cr or submitted physically at the CFIA offices.
The outcome of this disciplinary process will determine whether the company and its responsible professional committed ethical and financial faults for a work that remained unfinished for more than eleven months, and sets a precedent regarding the duty of control and supervision of consulting firms registered with the CFIA toward their clients.
