Carmona aprueba la nueva ordenanza del mercado de abastos de la Plaza

The Plenary of the Carmona City Council definitively approved on September 25, 2026, the modification of the General Ordinance regulating the supply market service and public utility of the Plaza de Abastos. The agreement, which concludes the administrative process, is now published in its full text in the Official Gazette of the Province of Seville number 190, corresponding to Wednesday, September 30, 2026, under the official reference BOP-SE-2026-190012. The announcement is signed by the mayor, Juan Manuel Ávila Gutiérrez, with an electronic signature date of September 28, 2026, and file number 2026012000000001.

The original regulation was approved by the Plenary on June 28, 2013, and published in the Official Gazette of the Province of Seville number 276, on November 28, 2013, and had already undergone a modification in 2024. The municipal market is located on Domínguez de la Haza street, and its stalls are public domain assets—inalienable, imprescriptible, and exempt from seizure—operated through administrative concession at the risk and venture of the concessionaire. The modification is approved under Article 49 b) of Law 7/1985, of April 2, Regulating the Bases of Local Regime, and Article 25.2.i) of the same regulation, which grants municipalities competence over supplies and markets.

Storage in separate and differentiated stalls

The central change affects Article 7 and Article 30 Bis. Until now, storage had to be developed in a contiguous, integrated, and complementary manner within the same stall as the main activity. Following the awarding of numerous concessions, the City Council found that some activities, especially those in the hospitality sector, require more storage space than fits in the awarded stall, which led to unwanted occupations of other spaces in the Plaza de Abastos.

The new wording provides for two modalities of private use:

  • Sales activity or provision of services and storage within the same stall.
  • Main activity and storage in differentiated and spatially separate stalls.

The technical project of each concession will determine in which stalls subject to bidding the second modality may be applied. The storage authorization will be accessory in nature and will automatically expire upon the termination, extinction, waiver, or transfer of the concession of the main stall; it is prohibited to conduct direct sales to the public, customer service, or the permanent exhibition of goods in the storage stalls.

Two years of activity before being able to transfer

Article 16.1 introduces a minimum period of two years of effective exercise of the activity, counted from the notification of commencement, in order to request the transfer of the concession through inter vivos acts. The stated objective is to avoid speculative practices and immediate transfers to third parties who did not participate in the tender nor prove the required requirements, including the viability plan.

The period may be waived in cases of permanent disability, retirement, serious illness, or other exceptional circumstances duly justified and assessed with reasoning by the City Council. The activity shall be understood to have been carried out effectively when the stall has remained open to the public in accordance with the conditions of the concession, a fact verifiable through a report from the municipal services.

Tenders, deadlines, and sanctioning regime

The consolidated text maintains the framework of the concessions: a duration of ten years, extendable for another identical period only once, award by open procedure, and the calling of tenders, if there are vacant stalls, within the first fifteen days of each semester, with publicity in the Official Gazette of the province and on the municipal electronic office. No bidder may be awarded more than two stalls from the same call.

The sanctioning regime sets fines up to 600 euros for minor infractions, from 601 to 900 euros for serious ones, and from 901 to 1,200 euros for very serious ones, with revocation of the concession for the serious breaches provided for in the specifications. Infractions expire in two months, one year, or two years depending on their classification.

The modification will enter into force once its full text is published in the Official Gazette of the Province and the period set forth in article 65.2 of Law 7/1985 has elapsed. Against the agreement, which exhausts the administrative route, a contentious-administrative appeal may be filed within two months from the day following this publication.

The regulation directly affects the current concessionaires of the Plaza de Abastos and future bidders: it expands storage options for businesses that ran out of space, but closes the path to rapid transfers of newly awarded concessions. The full text, including the modification annex and the consolidated text, remains accessible on the municipal transparency portal.
