Canarias sanciona con 49.181 euros a una empresa de frutos tropicales

The General Directorate of Labor of the Government of the Canary Islands has ordered the publication of the final sanction of 49,181.00 euros imposed on the company Francisca González Alemán, dedicated to the cultivation of tropical and subtropical fruits, for a very serious infringement regarding occupational risk prevention. The resolution, signed on September 30, 2026, is disseminated in the Official Gazette of the Canary Islands No. 204, corresponding to October 13, 2026, and concludes the sanctioning file SANREG 0048-2026.

A final fine after four months of proceedings

The procedure began with the infringement report issued on June 8, 2026, and concluded with the finality of the sanction on September 16, 2026, the date from which the resolution no longer admits administrative appeal. Only then, and in compliance with the legal mandate, did the competent body order its publication in the regional gazette.

The data made public by the Administration are as follows:

  • Sanctioned entity: Francisca González Alemán.
  • Sector of activity: cultivation of tropical and subtropical fruits.
  • National Identity Document of the natural person: 78****51.
  • Infringement committed: article 13.2 of the revised text of the Law on Infringements and Sanctions in the Social Order.
  • Sanction imposed: 49,181.00 euros.
  • Date of issuance of the infringement report: June 8, 2026.
  • Date of finality of the sanction: September 16, 2026.

The resolution corresponds to the Director General of Labor, José Ramón Rodríguez Albertus, who acts as the competent body by virtue of article 12.2.f) of Decree 37/2024, of March 4, which approves the Organic Regulation of the Ministry of Tourism and Employment. The announcement is framed within section V of the gazette, dedicated to announcements, under the heading of other announcements.

The publicity of this type of sanction is not a discretionary decision. Royal Decree 597/2007, of May 4, regulates in its article 2 the procedure for publicizing administrative sanctions imposed for very serious infringements in occupational risk prevention, in development of article 40.2 of Royal Legislative Decree 5/2000, of August 4. The regulation establishes that, once the sanctions become final, the competent body shall order them to be made public in the Official State Gazette or that of the autonomous community within its scope of competence.

Occupational risk prevention: the most serious tier of the law

The infringement is defined in Article 13.2 of the Law on Infractions and Sanctions in the Social Order, the provision that outlines conduct classified as very serious regarding occupational health and safety. This represents the highest level of administrative reproach and, therefore, the only one for which state regulations mandate nominal publication once administrative remedies have been exhausted.

Case file SANREG 0048-2026 concerns an activity—the cultivation of tropical and subtropical fruits—with a significant presence in the archipelago and specific risks associated with machinery handling, working at heights, and exposure to phytosanitary products. The resolution does not detail the specific event that prompted the sanction, beyond its classification under Article 13.2.

The publication of the sanction in the Official Gazette of the Canary Islands serves a dual purpose: it complies with the legal mandate to publicize very serious infringements in occupational risk prevention and exposes the administrative cost of failing to comply with health and safety obligations to the Canarian agricultural sector as a whole. For tropical fruit farms, the resolution serves as a reminder that monitoring preventive regulations results in sanctions which, in the very serious category, can exceed 49,000 euros.
