Cadalso eleva a definitivo la ordenanza antiincendios del ámbito periurbano

The Cadalso City Council has definitively approved the Municipal Ordinance for the Prevention of Forest Fires in the peri-urban area of its municipal district, after no claims were filed during the public exhibition period. The initial plenary agreement is thus elevated to definitive status, and its full text is published in the Official Gazette of the Province of Cáceres number 0207, dated Wednesday, October 28, 2026, Section I (Local Administration), pages 24433 to 24444, with official reference CVE: BOP-2026-5032. The announcement was signed in Cadalso on October 23, 2026, by the mayor-president, Francisco Ignacio Rodríguez Blanco.

An urban and rural policing regulation with regional backing

The ordinance is issued in compliance with Article 70.2 of Law 7/1985, of April 2, regulating the Bases of the Local Regime, and is configured as a complementary municipal instrument to state and regional regulations. The text is expressly supported by a regulatory framework headed by Law 5/2004 on the prevention and fight against forest fires in Extremadura and Decree 260/2014, of December 2, which regulates the prevention of forest fires in the autonomous community.

The catalog of references is completed by Law 3/2019 on the guarantee of municipal autonomy in Extremadura, Law 39/2015 on Common Administrative Procedure, the PREIFEX Plan, the associated technical regulations, and Cadalso’s own Municipal Peri-urban Forest Fire Prevention Plan (PPPI), which stands as the primary preventive planning instrument and whose determinations are mandatory for both landowners and the City Council itself.

400-meter strip and 50-meter protection band

The scope of application is the entire municipal district, with preferential attention to the peri-urban area defined in the PPPI. The peri-urban strip is configured perimetrically around the urban center with an average width of 400 meters starting from the urban land limit in the nuclei included in any of the High Forest Fire Risk Zones of Annex I of Decree 260/2014.

Within that strip, a protection band for the urban center is distinguished with a minimum width of 50 meters from the limit of the urban center, consisting of:

  • A vegetation-free perimeter line (LPD) 5 meters wide, immediately adjacent to the urban limit.
  • A protection area (APD) that completes the 50 meters, featuring fuel reduction treatments and self-protection measures.

Treatments must be adapted to the type of fuel and may include livestock grazing of the grassland, mowing, clearing or periodic tillage, removal of pioneer scrub, thinning of dense tree stands, and pruning to increase the distance between the ground and the canopies. In all cases, these shall be carried out annually and, as a general rule, before June 1 of each year, coinciding with the start of the high-risk period.

Obligated parties, inspection, and sanctions of up to 3,000 euros

The obligated parties are the owners, usufructuaries, and tenants of the affected plots; when the direct and beneficial ownership correspond to different persons, the obligation falls upon the holder of the beneficial ownership. Buildings must have a safety strip of at least 3 meters free of vegetation in their vertical projection, and vulnerable points—isolated buildings, facilities, equipment, or singular infrastructures—shall extend this band up to 30 meters of external protection area, with access for emergency vehicles, maneuvering spaces in dead-end roads, and operational water points.

Inspection is the responsibility of the municipal technical services, whose personnel shall be considered agents of authority. The sanctioning regime provides for:

  • Minor infractions: up to 750 euros.
  • Serious infractions: from 751 to 1,500 euros.
  • Very serious infractions: from 1,501 to 3,000 euros.

If the owner does not execute what is required, the City Council may act subsidiarily in accordance with Article 102 of Law 39/2015, charging the obligated party for the costs of personnel, machinery, transport, and waste management, enforceable via summary proceedings. In situations of serious or imminent risk, it may intervene immediately, without prior notice, even on plots without an identified owner, without altering the ownership regime in any case.

Closing

The regulation turns fire prevention into a direct and verifiable obligation for thousands of owners of peri-urban and urban land in Cadalso, with an annual calendar, inspection powers, and the municipal capacity to substitute the non-compliant individual at their expense. An administrative appeal may be filed against the agreement before the Administrative Litigation Chamber of the High Court of Justice of Extremadura, based in Cáceres, within two months from the day following the publication of the announcement, in accordance with Article 46 of Law 29/1998, of July 13.
