Cabra approves the zoning of ARI-16 and demands demolition without compensation
Por FactBox Admin

The Cabra City Council has definitively approved the Planning Study for the ARI-16 area of the town’s General Urban Planning Plan (PGOU), conditioning its effectiveness on the fulfillment of a series of economic and registry clauses. The agreement, signed in Cabra on October 13, 2026, by Mayor Fernando Priego Chacón, is published in the Official Gazette of the Province of Córdoba on October 19, 2026, in section VI (Local Administration), with official reference BOP-A-2026-3488 and secure verification code 5069 A253 A742 C376 816C.
Cash transfers and destination of funds
The effectiveness of the instrument is subject to the actual payment or the securing of the valued amounts, prior to or simultaneous with the granting of the building permit, in accordance with articles 173 and 174 of the LISTA Regulations (RLISTA). There are two liquid amounts:
- 10% mandatory transfer: 23,580 euros, destined for the public land heritage.
- Excess development rights: 6,750 euros, as a guarantee reserve for the equitable distribution of benefits and burdens across the entirety of Distribution Area AR-21; if it ultimately proves unnecessary, its destination will also be the public land heritage.
The agreement orders the Municipal Comptroller’s Office to register these amounts with an exclusive and specific destination for the Public Land Heritage.
Registry annotations and prohibition of segregation
An annotation must be inscribed in the margin of the plot’s deed regarding the duty of payment and settlement of the 10% increase in lucrative development and the excess development rights, prior to or simultaneously with the building permit. Furthermore, segregations are not permitted according to article 8.161 of the PGOU, a point that must also be inscribed as a marginal annotation.
Demolition without compensation and return of guarantee
Existing buildings on the plot must be demolished without right to compensation, as one of them is an irregular building and the other is a provisional building. Once the latter is demolished, the return of the guarantee established at the time to ensure demolition, which amounted to 1,004 euros, is applicable, as recorded in file GEX 2013/6401, relating to the provisional license for open-air parking and the annexed building structure.
Deposit, publication, and appeals
Prior to the publication of the resolution, the instrument must be deposited and registered in the Autonomous Registry of Planning Instruments of the Ministry of Development, Territorial Articulation and Housing, in the Registry Unit of Córdoba, in accordance with article 82.1 of the LISTA, Decree 550/2022, and Decree 2/2004. The Study has been registered under Registry Number 11.045 and deposited in the Municipal Registry of Planning Instruments under number SI Af010.
The City Council must send the complete document, duly processed, within one month from the final approval, and subsequently proceed to its full publication in the BOP and on the municipal electronic office (https://cabra.eu/planeamiento-desarrollo/). Approved instruments that are not published do not acquire validity nor produce any effect, according to article 83.4 of the LISTA. An administrative appeal may be filed against the agreement, which approves a provision of a general nature, before the Contentious-Administrative Chamber of the High Court of Justice of Andalusia based in Córdoba within two months, in accordance with article 46 of Law 29/1998.
The agreement directly affects the owners of the area, who assume the payment of the transfers before being able to build, the demolition without compensation of what has been constructed, and the impossibility of dividing the plot, conditions that constrain any urban planning operation in ARI-16.
