Por FactBox Admin

The Local Governing Board of the Cádiz City Council initially approved the Planning Study for the change of use in urban land of the properties located at calle Ancha, no. 24, and calle Santa María Soledad, no. 6, submitted by the company ILUNIÓN and by TELEFÓNICA DE ESPAÑA, S.A.U. The agreement, adopted in the session of September 25, 2026 (item 11), is published in the Official Gazette of the Province of Cádiz no. 197, of October 13, 2026, under reference No. 325,874, and opens a twenty-day period for public information.
The instrument is processed in accordance with Article 77 of Law 7/2021, of December 1, for the Promotion of Territorial Sustainability of Andalusia (LISTA) and Article 101 of Decree 550/2022, of November 29, which approves the General Regulation of the aforementioned Law (RGLISTA). The competence for the initial approval corresponds to the Local Governing Board, according to Article 21.1.j) of Law 7/1985, of April 2, regulating the Bases of the Local Regime, and Articles 75.1 and 78 of the LISTA.
The background of the file begins in the session of the Local Governing Board on October 17, 2025 (item 4), in which the Advance Planning Study was approved. This Advance was submitted for public information for thirty days, between October 23 and December 11, 2025, without any alternatives or suggestions being presented.
Environmental and health reports
Prior to the initial approval, the mandatory sectoral pronouncements were gathered:
- Territorial Delegation of Sustainability, Environment and Blue Economy: report of October 17, 2025, which determines that there is no need to environmentally evaluate the instrument as it has no significant effects on the environment.
- Territorial Delegation of Health and Consumption in Cádiz: report of December 10, 2025, which indicates that the instrument is exempt from submission to the health impact assessment procedure.
Justification for the change of use
The justification for the proposed change of use is the current lack of utilization and interior occupation of both properties, due to the modernization of equipment (transition from analog to digital systems) and the legal status of the decommissioning of these assets from public service, according to Law 11/1990, of April 24, General Telecommunications Law and the specific resolution of April 15, 2002, from the Secretary of State for Telecommunications and the Information Society of the Ministry of Science and Technology.
The main objective of the document, within the framework of Article 69 of the LISTA, is to establish the detailed planning and programming of an urban improvement action on urban land within the scope of a discontinuous homogeneous area. The file emphasizes that the change of classification of the plots does not imply a reduction in facilities, as the provision of telecommunications infrastructure services continues to be guaranteed through the update and improvement plan that has reduced the surface area occupied by the equipment.
Economic Transfer and Processing
The agreement accepts the equivalent economic substitution of the duty linked to the urban transformation of the 10% transfer of the increase in development rights, calculated as the difference in the repercussion value of the properties between the current equipment use and the proposed hotel use:
- Amount: €1,045,767.91 (one million forty-five thousand seven hundred sixty-seven euros and ninety-one cents).
- Concept: participation in the capital gains generated by the increase in development rights.
- Destination: municipal public land heritage.
- Legal basis: articles 28, 49.3, and 52.5 of the RGLISTA.
- Guarantee: favorable technical report from the municipal services.
The Study is submitted for public consultation for a period of twenty days through publication in the Official Gazette of the Province and on the notice board, in compliance with Article 78 of the LISTA and Article 104 of the implementing Regulation. Additionally, a report is requested from the Department competent in Territorial Planning and Urbanism as required by articles 75.2.b) and 78.4 of the LISTA, which is non-binding. The agreement was signed in Cádiz on September 28, 2026, by the Head of the Urban Planning Service, Juan Jesús Castillo Costilla.
The operation affects two unique properties in the historic center of Cádiz and entails the addition of new hotel capacity in an area of strong tourist pressure. The file is now in the hands of the citizens and the consulted bodies: any natural or legal person may examine the document and submit allegations during the twenty-day period, before the Local Government Board resolves on the final approval.
