Cádiz aprueba el avance del estudio de ordenación de Acacias 19

The Local Government Board of the Cádiz City Council approved on September 25, 2026, the Advance Planning Study for the property located at number 19 Acacias Street, promoted by the Rafael del Espino Foundation. The agreement, adopted under urgency item 10 of the session, is published in the Official Gazette of the Province of Cádiz number 199, dated October 15, 2026, under announcement reference No. 328,250. The document is subject to public review for thirty days.

The Advance defines a homogeneous area coinciding with the plot at 19 Acacias Street and Santa Cruz de Tenerife Street, in the Bahía Blanca neighborhood, to modify its detailed planning through an urban improvement action on urban land. The processing is supported by Article 77 of Law 7/2021, of December 1, for the promotion of the sustainability of the territory of Andalusia (LISTA) and Article 101 of Decree 550/2022, of November 29, which approves its General Regulation (RGLISTA).

The competence to approve the Advance corresponds to the mayor according to Article 21.1 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, but was delegated to the Local Government Board by decree of June 27, 2023, published in BOP No. 143, of 07/28/2023. The file includes reports from the Head of the Urban Planning Service and the Chief Architect of the Planning and Urban Management Service.

An urban improvement action in Bahía Blanca

The plot houses a four-story multi-family building constructed in 1990, which replaced one of the few villas that still remained in the block. The document describes the evolution of the Bahía Blanca neighborhood, whose lands—originally composed of villas and orchards—were progressively transformed during the second half of the 20th century, with the replacement of single-family housing by isolated collective buildings of high volume. The 1995 PGOU reduced the area understood as a garden city and assimilated the perimeter blocks of Bahía Blanca into the rest of the collective buildings of the modern Expansion.

According to Article 27 of the LISTA, urban improvement actions are those which, on urban land, aim to increase buildability, the number of dwellings, or the change of use or typology, when they require new public facilities, general or local, or imply an increase in urban development without the need for reform or renovation of the urbanization.

Stated objectives and content of the document

The Study bases the proposal on the improvement of the population’s well-being and on the following objectives:

  • Increase in buildability to increase the number of homes and meet the high social demand.
  • Improvement of the urban image through the homogenization of heights and alignments.
  • Improvement of the provision of neighborhood facilities.

The Advance incorporates, among other determinations, the identification of the properties within the area and their owners, legal occupants, and holders of real rights; the justification of the urban improvement with a comparative study of buildability, density, uses, building typologies, and urban provisions; and an economic viability report in terms of the equitable distribution of benefits and burdens.

Public information and environmental processing

The agreement contains three pronouncements:

  • Approve the Advance of the Planning Study presented by the Fundación Rafael del Espino (CIF G14423651).
  • Submit it to public information for thirty days to gather the opinion of the citizenry and other potential interested parties.
  • Request from the Territorial Delegation of Sustainability, Environment and Blue Economy the appropriateness of initiating the simplified strategic environmental assessment procedure, in accordance with Article 40 of Law 7/2007, of July 9, on the Integrated Management of Environmental Quality of Andalusia.

The file includes a report dated March 13, 2025, from the Ministry of Sustainability and Environment which exempted the action from the environmental assessment procedure, considering that it does not have a significant impact on the environment. However, as it was issued in accordance with Law 7/2007, repealed since June 20, 2026, and was not incorporated into the presented Study, a new express pronouncement from the environmental body is deemed convenient. The Advance is considered a draft plan for the purposes of the environmental procedure and internal preparatory administrative effects.

The approval opens a one-month period for residents and entities to submit allegations regarding a project that will increase buildability and the number of homes in a plot of Bahía Blanca, with the consequent acquisition of new provisions and neighborhood facilities. The announcement is signed by the Head of the Urban Planning Service, Juan Jesús Castillo Castilla, in Cádiz on September 29, 2026.
