Boadilla activa la Ley 2/2026 y sumará 282 viviendas protegidas más

The Boadilla del Monte City Council will apply the special regime provided for in Law 2/2026, of June 11, on Urgent Measures to Increase the Supply of Publicly Protected Housing within its municipal boundaries. This was decided by the Plenary in an ordinary session on October 14, 2026, and the agreement is now published in the BOCM no. 260, of Thursday, October 29, 2026, pages 223 to 226, with the official reference BOCM-20261029-74 (file 03/16.961/26).

Partial application and reservations

The approved agreement includes the Technical Urban Planning Document (Annex I), which establishes the specific scope of the regulation in the municipality. The technical report was signed on August 17, 2026, by the Directorate of Architecture, Urban Planning, Activities, Industry, and Environment and was subject to public consultation for twenty business days, during which no objections were filed.

The document outlines three alternatives and opts for a selective application of the law:

  • Land classified for tertiary use: the agreement reached in the Plenary and the municipal decision already adopted regarding Article 2 of Law 3/2024 are maintained.
  • Private endowment land: the law is not applied. The report claims that these are located in historical low-density urbanizations with old and limited sanitation, water supply, and road infrastructures; therefore, introducing housing would distort the city model and require high investment.
  • Industrial land: no change is required because the tertiary-commercial ordinance of the General Plan already allows for 1st, 2nd, and 3rd category hospitality commercial facilities, which enables the temporary accommodation modality contemplated by the law.

Three plots and 282 additional homes

The law is applied to unbuilt plots classified by planning for protected housing, using alternative 1, titled “Partial: 30% density increase”:

  • MZ-9 AB, in the AH-38 Valenoso area: surface area of 46,975.65 square meters; increasing from 540 to 702 homes (162 more); buildability of 59,940 square meters, four floors, and maximum occupancy of 50%.
  • MZ-2.2, in the AH-35 “El Encinar” area: 15,734.67 square meters; from 248 to 322 homes (74 more); buildability of 29,253 square meters, four floors, and 50% occupancy.
  • MZ-2C.1, MZ-2C.2, MZ-2C.3, and MZ-2C.4, of AH-35 “El Encinar” as a real estate complex: 16,747.44 square meters; from 152 to 198 homes (46 more); buildability of 16,872 square meters, four floors, and 50% occupancy, under the RM-IE-PP ordinance.

The total amounts to 282 additional protected homes (162 + 74 + 46), which, added to the 1,310 obtained through the application of Law 3/2024, result in 1,592 more homes than those provided for in the planning. With a ratio of three inhabitants per home, the document calculates 4,776 additional inhabitants above the plan’s population ceiling.

Processing, appeals, and growth of the public housing stock

The agreement is final in administrative proceedings. An optional appeal for reversal may be filed before the same body within one month from the day following its publication in the BOCM, in accordance with articles 123 and 124 of Law 39/2015, or directly as a contentious-administrative appeal before the Contentious-Administrative Section of the Madrid Court of First Instance within two months, according to articles 8, 45, and 46 of Law 29/1998.

The City Council will publish the decision on the official notice board, the municipal website, the Transparency Portal, the BOCM, and one of the widest-circulation newspapers in the Community of Madrid, and will notify the Community for the purposes provided by law. The document was signed in Boadilla del Monte on October 19, 2026, by the Councilor for Urban Planning, Housing, and Building Maintenance and Cleaning, María Luz de Baldasano Valdés.

The declared impact is a 6% increase in the number of homes, which, added to the 41.4% already approved under Law 3/2024, raises the growth of the municipality’s public housing stock to 47.4%. The decision affects land owners and developers of the three affected plots and sets the municipal protected housing policy for the coming years.
