Benestar Social defineix les funcions de tots els seus llocs de treball

The Official Gazette of the Balearic Islands (BOIB) publishes this Thursday, November 5, Order 43/2026, of October 30, which approves the functions of all job positions within the Department of Families, Social Welfare and Dependency Care and its hierarchical structure. It is signed by the counselor Sandra Fernández Herranz and affects management, technical, and administrative personnel in social services, dependency, disability, families, and childhood. The regulation comes into force the day after publication, that is, this Friday, November 6.

The provision, which bears number 11142 and occupies page 61651 of BOIB no. 141 (fascicle 309, section I), implements article 34.3 of Law 3/2007, of March 27, on the public service of the Autonomous Community of the Balearic Islands, which attributes to each counselor the determination of the functions of the positions assigned to their department. It also complies with Instruction 1/2012, of February 28, which establishes the formal criteria for these functional orders. This organization replaces Order 25/2024 of the counselor of Families and Social Affairs (BOIB no. 97, of July 23, 2024), which is hereby repealed, and maintains the validity of the Order of October 25, 2010 (BOIB no. 162, of November 6, 2010) regarding the execution of non-custodial judicial measures.

The document consists of four articles and two annexes: annex 1 describes the functions of each job position and annex 2 establishes the hierarchical dependency between positions. The scope covers the entire department created by Decree 7/2025, of July 11, and organized by Decree 10/2025, of July 14, with deployment in Mallorca, Menorca, Ibiza, and Formentera through the units of Palma, Mahón, Ibiza, Inca, Manacor, and Marratxí.

Five management centers and territorial deployment

Annex 1 organizes the department into five management centers, one more than those listed in the preamble:

  • General Secretariat, with legal services, the administrative contracting unit, general affairs, personnel, and economic management.
  • General Directorate of Social Welfare, competent in the planning of social services and benefits.
  • General Directorate of Dependency Care and Persons with Disabilities.
  • General Directorate of Families, Childhood, Youth, Diversity and Equality.
  • Balearic Office of Childhood and Adolescence (OBIA).

Additionally, the regulation incorporates into the organization the personnel of the Consortium of Socio-Sanitary and Assistance Resources of the Balearic Islands, with architect and middle-grade technician positions assigned to the Mallorca unit.

Grade assessment, PIA and benefits

The General Directorate of Dependency Care concentrates the most sensitive functions for the citizenry. The order explicitly assigns who assumes the assessment and recognition:

  • The Degree Recognition Service supervises the dependency and disability assessment files and directs the annual degree review plan.
  • The Benefits and Services Recognition Service processes the benefit recognition phase, prepares the PIAs, and supervises the island reservation centers.
  • The Disability and Dependency Assessment and Guidance Service presides over the assessment body created by Decree 91/2019, of December 5, and coordinates the assessment teams (EVO).
  • The Primary Care Assessment Service (SVAP) integrates physiotherapists, speech therapists, psychologists, occupational therapists, and social workers.
  • The assessment teams are deployed in Palma, Menorca, Ibiza, Inca, and Manacor.

The text also details the functions of doctors, psychologists, social workers, and assessment technicians, including home visits for people who prove they cannot travel and participation in the UDIAP and in the monitoring of SEDIAP and SEPAP.

Economic benefits, statistics, and data protection

In the General Directorate of Social Welfare, the order separates the Department of Social Services from the Department of Social Benefits and distributes the processing among managers, processors, social workers, and benefit and accounting assistants, with explicit references to the guaranteed social income. The General Directorate of Families, in turn, organizes the services for Family, Juvenile Justice, Youth, Sexual and Gender Diversity, and Personal Autonomy Processes.

Other highlighted elements of the regulation:

  • Article 4 designates the department’s Statistical Unit and assigns its coordination to the general director of Social Welfare competent in social services planning.
  • Article 3 establishes the substitution regime: when a head of department or service is vacant, the functions are assumed by the immediately superior position according to annex 2.
  • Positions with a destination supplement of 26 or higher generically assume collaboration functions regarding data protection and the National Security Framework.
  • The Legal Service II exercises the data protection coordinator functions provided for in article 7.2 of Decree 42/2024.

The organization has a direct effect on the staff and on the citizens: it establishes in writing who resolves a dependency file, who reviews a disability degree, and who processes an economic benefit, thus becoming the reference map for demanding accountability and for interpreting the terms of the procedures. It also closes the regulatory dispersion open since the creation of the department in 2025, when the current functions still originated from a previous administrative structure.
