Balsa de Ves repeals the municipal capital gains tax and opens a 30-day period for objections
Por FactBox Admin

The Balsa de Ves City Council has opened the public information process for the repeal of the Fiscal Ordinance regulating the tax on the increase in value of urban land, commonly known as the municipal capital gains tax (plusvalía municipal). The agreement, provisionally adopted by the Plenary in an ordinary session on October 2, 2026, is published in the Official Gazette of the Province of Albacete number 124, dated October 23, 2026, in the Third Section: Local Administration (official reference 26.203). The public exhibition period lasts for 30 days, during which interested parties may examine the file and submit claims.
The announcement is based on Article 17 of Royal Legislative Decree 2/2004, of March 5, which approves the revised text of the Law Regulating Local Treasuries, which regulates the procedure for the modification and repeal of municipal fiscal ordinances. According to the published text, the agreement is considered definitively adopted if no claim is filed against it within the legally established period.
The repeal affects a municipal tax that levies the transfer of urban land, meaning its disappearance leaves the settlement of capital gains within the municipal district without local regulatory coverage. The file remains in a provisional phase for now: the repeal will not be finalized until the allegations period concludes and the Plenary resolves, if applicable, the claims submitted.
Thirty days to examine the file and submit allegations
The process enabled by the City Council adheres to the following calendar and conditions:
- Public exhibition period: 30 days from the publication of the announcement in the Official Gazette of the Province.
- Place of consultation: the City Council Secretariat, where the complete file is deposited.
- Who may intervene: any interested party, through claims submitted within the deadline.
- Effect of the absence of claims: the provisional agreement becomes definitive without further procedure.
A plenary session with several fiscal ordinances
The repeal of the capital gains tax is only one of the fiscal files that the Plenary of Balsa de Ves approved in the ordinary session of October 2, 2026, and which are published in the same issue of the provincial gazette. Among them are:
- The modification of the Tax Ordinance on constructions, installations, and works, also in the provisional phase and with 30 days for allegations (reference 26.202).
- The modification of the fee for the drinking water supply service, likewise provisional and with 30 days of public exhibition (reference 26.204).
- The modification of the Tax Ordinance on real estate (IBI), which has already become final as no claims were registered (reference 26.226).
- The credit modification file number 9/2026 (9-2 CE/SP), for a credit supplement financed by Treasury surplus for general expenses of the 2026 budget, exhibited for 15 days (reference 26.201).
In the case of the real estate tax, the full publication sets the tax rates at 0.40% for urban properties, 0.40% for rural properties, and 1.3% for properties with special characteristics. A contentious-administrative appeal against this final agreement may be filed before the High Court of Justice of Castilla-La Mancha within two months. The announcements for the remaining files are signed by the mayor, Natividad Pérez García.
What changes for those selling a property
The municipal capital gains tax (plusvalía) is settled upon the transfer of urban land, therefore the repeal of its ordinance has a direct impact on sellers, heirs, and donees of properties located in the municipality. While the file is under public review, the text does not yet provide details on the settlement of previous years or the transitional regime, issues that must be resolved upon final approval.
The relevance of the news is twofold: on one hand, it clears up the application of a tax that affects any real estate operation in Balsa de Ves; on the other, it confirms that the City Council has addressed the complete review of its fiscal package in a single session, from the capital gains tax and IBI to water and construction. Interested parties have 30 days to file allegations before the repeal becomes final.
