Baena delega en García Malagón las actas de la expropiación de Albendín

The Baena City Council has granted a special delegation to council member José Andrés García Malagón to represent the Mayor’s Office and the Council in the drafting of the preliminary records prior to the occupation of assets and rights affected by the compulsory expropriation of the waste collection system and the Albendín WWTP (Waste Water Treatment Plant). The decision was formalized in a Mayoral decree signed on October 23, 2026, and published in the Official Gazette of the Province of Córdoba No. 210, dated October 29, 2026 (reference BOP-A-2026-3626). Affected owners within the municipal district are summoned on November 16, 17, 18, 23, and 24, 2026.

A file processed by the Junta de Andalucía

The procedure is being conducted by the Territorial Delegation of Agriculture, Fisheries, Water and Rural Development in Córdoba, which, through a resolution dated September 28, 2026—published in the BOP No. 203, dated October 20, 2026, with reference BOP-A-2026-3322—convened the preliminary records and initiated the urgent compulsory expropriation file, registered under number 14/001/02/2026.

The affected project is the “CONSTRUCTION PROJECT FOR THE WASTE COLLECTION SYSTEM AND ALBENDÍN WWTP, MUNICIPAL DISTRICT OF BAENA (CÓRDOBA)”, with key A5.314.1083/2112. Its main figures are:

  • Technical approval of the project by the General Directorate of Water Infrastructure on April 16, 2026.
  • Public information announced in the BOJA on June 2, in the BOP of Córdoba on June 17, in the Córdoba newspaper on June 5, and on the municipal notice board on June 8, 2026.
  • Final approval of the public information file on September 7, 2026.
  • Total budget, including the project, of 5,789,777.75 euros and an execution period of 18 months.
  • Final beneficiary of the expropriation: the Baena City Council.

The declaration of public utility and social interest and the need for urgent occupation derive from Article 29.3 of Law 9/2010, of July 30, on the Waters of Andalusia, which allows for the application of the procedure in Article 52 of the Compulsory Expropriation Law of December 16, 1954.

Appearances over five days in November

The records will be drawn up at the premises of the Baena City Council, with individual summons for each interested party and notification of the appointment. The schedule set in the annex of the resolution is as follows:

  • November 16: attendees summoned between 10:00 and 13:00 hours.
  • November 17: session from 10:00 to 13:00 hours.
  • November 18: appointments from 10:00 until 13:00 hours.
  • November 23: slots between 10:00 and 12:30 hours.
  • November 24: final appointments, from 10:00 to 11:45 hours.

Interested parties must appear in person or through a representative, providing DNI or NIF and documentation proving ownership (a nota simple or certificate from the Property Registry, public deed, or receipt of the Property Tax from the last year). They may be accompanied, at their own expense, by experts and a notary. Failure to appear will be understood as being represented by the Public Prosecutor’s Office, in accordance with Article 5 of the Compulsory Expropriation Law.

Delegation limited to the act and political control

The decree argues reasons of administrative efficiency and the impossibility of the mayor attending simultaneously due to “other urgent matters of municipal management.” The authorization is based on Article 21.3 of Law 7/1985, regulating the Bases of the Local Regime, and Article 43.5.a) of the Regulation of Organization, Operation, and Legal Regime of Local Entities. The scope of the delegation is as follows:

  • It empowers the councilor to carry out the necessary in-person administrative actions and to sign the minutes and legal instruments linked to the expropriation act.
  • It takes effect on the day of signing and is automatically extinguished upon the conclusion of the drafting of the minutes.
  • Acceptance is understood to be tacit if the designee does not state otherwise within three business days.
  • It must be communicated immediately to the convening body and reported to the Plenary in the first ordinary session.

The annex of the resolution lists more than forty estates in the municipal district of Baena (Albendín), with areas of expropriation, easement, and temporary occupation that in some cases exceed 2,000 square meters of temporary occupation, as is the case with plot 105 of polygon 37. The estate with the largest expropriated area, plot 58 of polygon 24, reaches 7,960 square meters. During the act, acquisition by mutual agreement may be proposed (Article 24 of the Compulsory Expropriation Law); otherwise, valuation sheets and prior deposits will be formulated. An optional appeal for reversal may be filed against the resolution of September 28 within one month, or a contentious-administrative appeal within two months before the High Court of Justice of Andalusia.

What it means for the owners

The publication of this decree closes the municipal organization phase of a procedure that directly affects dozens of owners of rural estates in Albendín, who have only a few weeks to gather ownership documentation and appear at the assigned date and time. The call also opens the door to mutual agreement settlements that avoid the route of contentious fair price (justiprecio) and marks the material start of a sewage treatment infrastructure budgeted at nearly 5.8 million euros.
