Avilés aprueba el plan parcial de San Cristóbal con garantía del 3%

The Avilés Municipal Plenary definitively approved the Partial Plan for the Campo de San Cristóbal UZ R-12 residential sector, promoted by the company Herum Residencial, S. L., in an agreement adopted on September 22, 2026, under number 106/2026. The edict containing the agreement is published in the Official Gazette of the Principality of Asturias (BOPA) no. 215, dated November 6, 2026, section IV (Local Administration), under file AYT/14094/2023 and with identification code 2026-08862.

The agreement and its economic condition

The definitive approval of the planning instrument is conditional. The second point of the agreement requires Herum Residencial, S. L., in accordance with article 217.3.a 1st of the Territory and Urban Planning Regulations (ROTU), to guarantee three percent of the urbanization costs provided for in the Partial Plan, setting a maximum period of one month from the notification of the agreement for this purpose.

This guarantee operates as a prerequisite: the publication of the agreement, the urban planning regulations of the definitively approved plan, and the list of documents comprising the instrument is expressly conditioned upon the establishment of the aforementioned guarantee.

The file was processed at the request of the developer, and the definitive wording of the plan consists of the following documents:

  • Report and regulations of the Partial Plan for the Campo de San Cristóbal UZ R-12 residential sector (document PST1AI002O).
  • Plans (document PST1AI002P).
  • Annexes (document PST1AI002Q).
  • Standardization document (document LAC1AI01Q5).

Publication, notification, and regional control

Once the guarantee is fulfilled, the City Council will publish the agreement and the urban planning regulations in the BOPA and on the municipal electronic office, in application of article 70.2 of the Law on the Bases of the Local Regime (LBRL), article 25.2 of the Recast Text of the Land Law (TRLS), article 97 of the TROTU, and article 169 of the ROTU.

The agreement will also be notified to the interested parties appearing in the file, pursuant to article 158.2 of the ROTU. Likewise, it will be sent to the Urban Planning and Territory Ordering Commission of the Principality of Asturias for information, coordination, and archiving purposes, along with the certified text of the plan, the complete technical and administrative documentation, and a digital Spatial Database file with the graphic documentation in vector format, according to articles 23 of the TROTU and 168.1 of the ROTU.

The full content of the definitively approved project can be consulted on the municipal website of Avilés.

Deadlines for appeal

The edict, signed in Avilés on October 26, 2026, by the delegated councilor for Urban and Economic Development, opens the following avenues for appeal:

  • Appeal for reversal (recurso de reposición) before the same body that issued the agreement, prior to contentious-administrative proceedings, within a period of one month from the day following its publication in the BOPA.
  • Contentious-administrative appeal before the Contentious-Administrative Court of Oviedo within a period of two months from the day following publication, or directly following the implied rejection (silencio desestimatorio) of the appeal for reversal after one month, with a period then of six months.

The new planning defines residential land within the area of Campo de San Cristóbal and organizes the urban development of this sector of the municipality. Its effective entry into force will not be immediate: it depends on the developer establishing the 3% guarantee of urbanization costs, a condition that the City Council has expressly linked to the full publication of the urban planning regulations. Neighbors and affected interested parties have one month to react to an instrument that reorganizes land use in this area of Avilés.
