Asturias exime del reintegro del salario social los errores de la Administración

The Department of Social Rights and Welfare of the Principality of Asturias has published the instructions developing the Law of the Principality of Asturias 6/2026, of September 10, to protect recipients of the basic social salary against the reimbursement of benefits collected due to actions attributable to the Administration itself. The measure is formalized through the Resolution of October 19, 2026, published in the Official Gazette of the Principality of Asturias (BOPA) No. 205, of October 22, 2026, with official reference Code 2026-08604. The instructions enter into force the day following their publication, namely, October 23, 2026.

The regulation now being developed, Law 6/2026, of September 10, amended Law 3/2021, of June 30, on the Guarantee of Vital Rights and Benefits and introduced a new Article 18 bis intended to prevent the beneficiary from bearing the economic consequences of administrative errors. Its first final provision required the competent Department to issue, within one month of its entry into force, instructions to identify the affected files, suspend collection or offset actions, and ensure a homogeneous application of the precept. The resolution bears the signature of the counselor Nerea Monroy Rosal and is based on Decree 22/2023, of July 31, on the restructuring of the Departments.

Six categories of files

The instructions order the classification of all basic social salary and vital supplement files affected by reviews with possible reimbursements into six groups:

  • Reviews at the request of a party pending processing from which reimbursements or offsets may derive.
  • Reviews at the request of a party in the processing phase with the same risk.
  • Reviews already notified by resolution that has not yet become final.
  • Final reimbursement resolutions not fully satisfied.
  • Amounts already reimbursed, totally or partially.
  • Procedures derived from the granting of the Minimum Vital Income (IMV).

In pending files, processing will be expedited, unnecessary formalities will be omitted, and deadlines will be reduced, with the possibility of precautionary suspension of payment in accordance with Article 31 of Law 3/2021. Furthermore, the Administration will avoid requesting documents to which it already has access.

One-year suspension of collection actions

The General Directorate for the Management of Social Rights will issue suspension resolutions in procedures under processing and in those with a notified resolution but without a payment letter issued. The maximum suspension period may not exceed one year from the entry into force of Law 6/2026, after which it will be lifted automatically.

For final debts that have not been satisfied, all collection actions are cautiously suspended for one year: granted deferrals and installments, enforcement proceedings, compensation or payroll deductions, and withholdings. The suspension shall not apply when there are reasoned indications of fraud, bad faith, or relevant concealment, a fact that will be notified to the interested person and communicated to the Public Tax Services Entity of the Principality of Asturias.

Refund of amounts already paid and new form

Those who have fully or partially repaid amounts included within the scope of Article 18 bis may request the recognition of the right to a refund within one year, provided that the four-year prescription period since the payment has not elapsed nor is there a final judgment with the force of res judicata. The request shall be addressed to the General Directorate for the Management of Social Rights using the standardized form PSPM0004T03, approved as Annex II of the resolution, which allows for the marking of the affected benefit:

  • Basic social salary.
  • Vital supplement for families with minors and young people.
  • Vital supplement for dependency or disability.
  • Vital supplement for housing rent.

The form collects the debt data, the method of collection, and the bank details for the refund, and includes the responsible declaration and the authorization to consult data from Social Security, the State Public Employment Service, the State Tax Administration Agency, the Cadastre, and the Ministry competent in justice matters, among other organizations.

The impact is direct for all recipients of the basic social salary and its vital supplements in Asturias: as of October 23, 2026, the collection of debts derived from administrative errors is halted, and the way is opened to recover what has already been paid, with a one-year window to submit the request.
