Arequipa aprueba ordenanza regional para la gobernanza responsable de la inteligencia artificial

The Regional Council of the Regional Government of Arequipa approved Regional Ordinance No. 562-AREQUIPA, which establishes guidelines for the governance, development, implementation, and responsible use of artificial intelligence-based systems within the entity and the region. The regulation was promulgated by the regional governor Rohel Sánchez Sánchez on October 6, 2026, and is published this Thursday, October 8, in the Legal Norms section of the Official Gazette El Peruano.

The ordinance was approved by the plenary of the Regional Council at the headquarters of the Regional Government of Arequipa on September 22, 2026, signed by the president of the Regional Council, Norma Alejandra Ortega Valdivia. It is based on the Political Constitution of Peru, Law No. 27783, the Framework Law on Decentralization, Law No. 27867, the Organic Law of Regional Governments, and the regional legislative framework of Regional Ordinance No. 154-AREQUIPA.

Its objective is to regulate the use of artificial intelligence to improve public management and the provision of services to citizens, in accordance with Law No. 31814 and its regulations, the National Artificial Intelligence Strategy, the Digital Government Law, and the provisions of the governing body of the National Digital Transformation System.

Principles and institutional policy

Article 2 incorporates the following principles as guiding factors for the development and use of artificial intelligence systems:

  • Non-discrimination and privacy of personal data.
  • Protection of fundamental rights and respect for copyright and related rights.
  • Security, proportionality, and reliability.
  • Awareness and education in artificial intelligence, and sustainability.
  • Human oversight, transparency, and accountability.
  • Ethical development for responsible artificial intelligence and risk-based security standards.

Article 3 tasks the Governance and Digital Transformation Committee, chaired by the regional governor or their representative, with drafting, approving, and implementing the Institutional Policy for the safe, responsible, and ethical use of artificial intelligence-based systems.

Inventory of systems and projects with public value

Article 4 stipulates that the Office of Digital Transformation and Information and Communication Technologies shall implement and maintain an updated institutional inventory of the artificial intelligence systems used, developed, or acquired by the entity. This inventory must contain, at a minimum:

  • The purpose of the system.
  • The responsible body.
  • The main functionalities.
  • The type of system.
  • The personal data processing policy.

The organs and organic units that develop, acquire, implement, or use these systems must observe the principles of the ordinance. Article 5 charges the Regional Management of Science, Technology, and Innovation with promoting artificial intelligence and digital technology projects oriented toward public value, efficiency, and the addressing of public problems, as well as coordinating the replication of best practices with the local governments of the region.

Training, monitoring, and regional scope

Article 6 establishes that the Governance and Digital Transformation Committee shall develop training activities in digital competencies, the application of artificial intelligence in public management, and artificial intelligence ethics for public servants, in coordination with the Comptroller General of the Republic, the National Civil Service Authority (SERVIR), and the Secretariat of Government and Digital Transformation of the Presidency of the Council of Ministers.

Article 7 obliges the Committee to submit a quarterly internal report to the Regional Council on the progress of the implementation of the institutional policy, the artificial intelligence projects of the current Digital Government Plan, the systems identified in the inventory, and the actions developed. This submission does not replace the reporting, evaluation, and monitoring mechanisms established by the Presidency of the Council of Ministers for Law No. 31814 and its regulations.

Article 8 promotes that the public entities of the region progressively adopt measures and mechanisms for the governance, development, and use of artificial intelligence systems, and that the Regional Government promotes spaces for coordination, exchange of best practices, and training with the governing body.

The regulation makes the Regional Government of Arequipa one of the first subnational governments in the country with its own governance framework for artificial intelligence, with concrete obligations regarding inventory, human supervision, and periodic reporting. For the citizens of the region, the impact translates into transparency and data protection rules applicable to the automated systems that the regional administration already uses or incorporates in the future.
