Arenales de San Gregorio aprueba definitivamente la ordenanza de parques y jardines

The City Council of Arenales de San Gregorio has made the Municipal Ordinance regulating parks and gardens final, as no claims were filed during the public exhibition period. The initial plenary agreement, dated September 14, 2026, is thus automatically approved in compliance with article 70.2 of Law 7/1985, of April 2, regulating the Bases of the Local Regime. The full text is published in the Official Gazette of the Province of Ciudad Real number 209, of October 29, 2026, in announcement number 3485, with verification code MzW1+Te+LyGoGLkWBcso.

From the initial agreement to final publication

The process began with the initial approval by the Plenary in an ordinary session on September 14, 2026, in accordance with articles 49 and 70.2 of Law 7/1985 and article 56 of the Revised Text of the Local Regime. The announcement of initial approval was inserted in the provincial gazette and opened a public information period of thirty days to submit allegations; this period having closed without claims, the agreement is considered final.

The regulation is structured into a statement of motives, six chapters, and 29 articles, plus two final provisions. Its declared objective is to provide the municipality with a legal instrument for the protection of public landscaped areas and to make residents aware of a “logical and appropriate” use that preserves the “aesthetics, tranquility, and peace” of these spaces.

Public events, trees, and furniture

Article 3 establishes that parks and gardens, due to their status as assets of public domain and use, may not be privatized for events pursuing private purposes. If public events are authorized in the general interest, they must be communicated and requested at the city council with sufficient notice, and measures must be adopted to avoid damaging trees, plants, or furniture. Damages caused during these events shall be the responsibility of those who requested the authorization or the entities in whose name they did so.

Regarding trees, no specimen from public roads or municipal parks and gardens may be uprooted or felled without a decree from the Mayor’s Office and a prior report from the Municipal Technical Services; planting, fertilizing, pruning, or performing tree surgery requires a municipal license. Furthermore, the following are prohibited:

  • Manipulating trees and plants, cutting flowers or branches, and stepping on the grass outside of designated areas.
  • Depositing construction materials or waste in tree pits and landscaped areas.
  • Lighting fires outside of authorized locations.
  • Washing vehicles or clothing and taking water from irrigation outlets.
  • Camping, except in designated spaces.
  • Carrying out repair, masonry, gardening, or electrical work.
  • Painting graffiti, making inscriptions, or pasting posters.
  • Using children’s play equipment outside of the indicated ages; the gym equipment in the Municipal Park is for adults.

Dogs, vehicles, and opening hours

Chapter IV requires dog owners to prevent and collect waste, prohibits animals from accessing lawns and children’s play areas, and limits their transit to the park’s crushed stone paths, the concrete esplanade of the municipal pool bar, and other paths and sidewalks, always on a leash and with a muzzle for those considered dangerous or large-sized.

Regarding circulation, the entry of motorized vehicles into the municipal park, gardens, and green areas is prohibited, except for municipal maintenance vehicles and exceptional authorizations. Bicycles, skates, and skateboards may only circulate in designated areas, while vehicles for people with reduced mobility may do so in all parks, with the necessary entrances being enabled. Enclosed areas will open according to the schedules set by the Mayor’s Office, which are reviewable by time of year; the rest will remain illuminated and open day and night.

Street drinking, reports, and sanctioning regime

Article 5 prohibits activities that cause accidents, damage plant species or furniture, impede passage, or disturb the peace, with express mention of “botellón” (street drinking). The Civil Guard may cautiously seize drinks and containers, which will be destroyed for hygienic reasons, and the established facts will serve to open sanctioning proceedings. The practice is serious if it severely alters coexistence or degrades health and safety, and very serious if the work of the officers is obstructed.

Any person, natural or legal, may report infractions to the city council, and officers of the Civil Guard and personnel from the Parks and Gardens Service will file the appropriate reports. Infractions are classified as minor, serious, and very serious, with the following amounts according to Article 141 of Law 57/2003, of December 16:

  • Minor: fine of up to 750 euros.
  • Serious: from 750.01 to 1,500 euros.
  • Very serious: from 1,500.01 to 3,000 euros.

The imposition of fines corresponds to the Mayor’s Office, which may also develop the articles through official proclamations, and anyone who has committed an infringement on the same matters within the previous twelve months shall be considered a repeat offender. An administrative appeal may be filed against the agreement, which concludes the administrative process, before the High Court of Justice of Castilla-La Mancha within two months of its publication.

The new ordinance affects any resident or entity organizing events in the municipality’s green areas and reinforces the municipal capacity to sanction the deterioration of plant heritage and urban furniture, while transferring direct responsibility for damages to the organizers.
