Aragón declares public utility for the San Peirón II photovoltaic plant in Teruel
Por FactBox Admin

The Department of Economy, Competitiveness and Employment of the Government of Aragon has specifically recognized the public utility of the San Peirón II photovoltaic plant, promoted by the company Energías Renovables de Fauno, SL within the municipal boundaries of Orrios and Perales del Alfambra (Teruel). The decision is adopted through Order ECE/1482/2026, of September 22, published in the Official Gazette of Aragon number 202, of October 19, 2026, in section III of other provisions and agreements (csv BOA20261019022). This recognition enables the compulsory expropriation of the assets and rights necessary for the establishment of the installation and the imposition and exercise of the right-of-way easement.
The order is based on articles 54 and 56 of Law 24/2013, of December 26, on the Electricity Sector, and on Decree-law 2/2016, of August 30, of the Government of Aragon. Jurisdiction corresponds to the Autonomous Community because the plant has an installed capacity of less than 50 electrical MW, as reasoned in the file. The resolution bears the signature of counselor Eva Valle Maestro and is processed under files DGEM: IP-PC-0177/2021, SP: G-T-2020-053, TE-AT0181/20 and DUP-T-2025-0011.
Three years of administrative processing
The prior administrative and construction authorization for the plant was granted by Resolution of October 16, 2023 of the General Directorate of Energy and Mines, published in the Official Gazette of Aragon number 225, of November 22, 2023. That project already included as an annex the list of affected assets and rights, with a description of the impacts on each property.
The declaration of public utility was requested on October 3, 2025, and the promoter provided the specific and individualized list of assets to be expropriated on November 12. The public information process was published in the Official Gazette of Aragon number 7, of January 13, 2026, and in the Diario de Teruel on the same date, in addition to being notified to the city councils and the cadastral owners. Neither the City Council of Orrios nor that of Perales del Alfambra issued a report, which the instructing body understands as having no objection according to article 146 of Royal Decree 1955/2000.
Seven dismissed allegations and three properties removed
During the public information period, seven allegations were presented, all of which were dismissed:
- Asociación de Apoyo a Teruel Existe (A1), which questioned the fragmentation of the project, the regional competence, and the lack of justification for the location.
- José Luis Castelló Fortea (A2), owner of plot 8013 of polygon 501.
- Pedro Manuel Escuder Gimeno (A3), María del Carmen Ruiz Domínguez (A4), Raquel Gómez Ramo (A5) and Lorenzo Escuder Gimeno (A6), owners of plots 169, 187 and 20168 of polygon 501.
- Florentina Ferrer Morte (A7), owner of plot 183 of polygon 501.
The Provincial Service of Teruel issued a report on April 13, 2026, and assessed the recognition favorably. The instructing body rejected the association’s arguments regarding the status of interested party and reminded that allegations must be limited to public utility, not to issues already resolved in the authorization. It also emphasized that the alleged case of FV Godelleta 12 is not comparable, because in that instance, the plots occupied by the modules were expropriated.
Following the public information period, the promoter submitted responsible declarations dated February 24, 2026, and April 1, 2026, to deregulate three estates, which are excluded from the list of assets and rights:
- Orrios: polygon 3, plot 3.
- Perales del Alfambra: polygon 501, plots 169 and 20168.
Twelve affected estates, all in polygon 501
The annex of the order lists twelve estates, all of them in the municipality of Perales del Alfambra, polygon 501, with arable or dryland farming. The impact is limited to the underground evacuation line and the right-of-way for surveillance and maintenance, which allows the cultivation to be maintained. Among the impacts are:
- Plot 187, belonging to the Escuder Gimeno, Ruiz Domingo, and Gómez Ramo siblings: 298 linear meters, 1,881 m² of surface area and 1,656 m² of easement.
- Plot 8013, belonging to José Luis Castelló Fortea: 290 linear meters, 1,615 m² and 1,465 m² of easement.
- Plot 183, belonging to Florentina Ferrer Morte: 203 linear meters, 927 m² and 910 m² of easement.
- Plot 180, belonging to Ana Isabel Ferrer Gil: 90 linear meters, 500 m² and 814 m² of easement.
The order warns that the valuation of damages and compensation will be resolved during the fair price phase of the expropriation procedure, which is processed via the urgency route of Article 52 of the Forced Expropriation Law of 1954. Against the resolution, which exhausts the administrative route, an optional appeal for reversal may be filed within one month, or a contentious-administrative appeal may be filed before the Contentious-Administrative Chamber of the High Court of Justice of Aragon within two months.
The declaration of public utility closes the administrative route for the affected owners and clears the way for the execution of a renewable installation that has been under processing for three years in Teruel. For the owners of the twelve estates in polygon 501, the next step is the occupation of the land and the negotiation of the fair price, with the possibility of appealing before the TSJA.
