Arévalo reclassifies 5,320 square meters of protected land as urban industrial

The Territorial Commission for Environment and Urban Planning of Ávila has definitively approved specific modification no. 28 of the General Urban Development Plan of Arévalo (Ávila), which reclassifies non-developable land of special protection as urban industrial land. The agreement was adopted unanimously in the session of January 29, 2026, and is now published in the Official Gazette of Castilla y León no. 185, of September 23, 2026, with the official reference BOCYL-D-23092026-185-15. The processed file is PTO. 19.24.

The collegiate body acts by virtue of the competence granted by article 138.2.b) of Law 5/1999, of April 8, on Urban Planning of Castilla y León, and article 3.1 d) of Decree 24/2013, of June 27, which regulates the functions and composition of the territorial commissions. The modification was promoted by Agustín López Sáez, S.L. and its stated objective is to enable the development of the industrial grid in the northwest area of the municipality, improving the urban layout and completing the infrastructure.

Three plots bordering urban land

The reclassification affects three cadastral plots, all of which border urban land, and is carried out partially:

• 05016A003202500000YQ, with 2,151 m².
• 05016A003102500000YS, with 29,853 m².
• 05016A003102490000YU, with 12,537 m².

The surface area finally affected by the change in classification amounts to 5,320.16 m², as stated in the project. This increase in buildable area exceeds the limits of article 173 of the Urban Planning Regulations of Castilla y León (RUCyL), which necessitates establishing the reserves provided for in the same regulation: 745.22 m² of public open spaces and 37 public parking spaces.

Favorable reports and archaeological condition

The file includes favorable reports from the Duero Hydrographic Confederation, the Government Sub-delegation in Ávila (Industry and Energy Department), the Territorial Service for Culture, Tourism and Sport of Ávila, the Citizen Protection Section of the Territorial Delegation, the Provincial Council of Ávila, and the Ministry for Digital Transformation and the Civil Service. The environmental procedure was resolved with Order MAV/1480/2025, of December 19, which formulates the strategic environmental report (File EAES/2025/036) and rules out the ordinary strategic environmental assessment, conditioned on the considerations of the Duero Hydrographic Confederation and the Civil Protection and Emergencies Agency.

Final approval is subject to the prescriptions of the Territorial Service of Culture, Tourism and Sport of Ávila: given the possible existence of archaeological evidence linked to the San Pablo site, archaeological controls of earthworks may be established within 200 meters of the site, with intervention projects authorized by the Territorial Commission of Cultural Heritage.

Processing and appeal process

The Plenary of the City Council of Arévalo initially approved the instrument on October 4, 2024, and provisionally on April 4, 2025. During the public information period, one allegation was submitted, according to the municipal certificate. The Territorial Service of Mobility and Digital Transformation issued a favorable report for final approval on January 23, 2026.

The agreement will be notified to the City Council of Arévalo, the State Administration, the Provincial Council of Ávila, the Property Registry, and, where applicable, to the claimants. A contentious-administrative appeal may be filed against it before the Contentious-Administrative Chamber of the High Court of Justice of Castilla y León, based in Burgos, within two months from the day following its publication. The document is signed by the secretary of the commission, Miguel Crespo López, and by the territorial delegate and president of the body, José Francisco Hernández Herrero, in Ávila, on September 15, 2026.

The decision unlocks the development of the northwest industrial estate of Arévalo and expands the available buildable area in the municipality, although it incorporates mandatory reserves for open spaces and parking, as well as preventive archaeological control in the surroundings of the San Pablo site.
