Demolition of a protected facade approved in Medina del Campo

Por FactBox Admin

Aprobado el derribo de una fachada protegida en Medina del Campo

The Regional Government of Castilla y León has definitively approved the modification of the General Urban Development Plan (PGOU) of Medina del Campo (Valladolid), which opens the door to the demolition of the protected facade of number 3 José Zorrilla Street. The decision is formalized in Order PRE/977/2026, of September 28, signed by the Counselor of the Presidency, Luis Miguel González Gago, and published in the Official Gazette of Castilla y León (BOCYL) number 192, of October 2, 2026, with the reference BOCYL-D-02102026-192-15. The file, processed for more than three years, affects the plots of numbers 3 and 5 of that street.

The objective of the modification is twofold: to enable the demolition of the facade of no. 3, which enjoys environmental protection, and to rectify the alignment of the front of the two plots that make up the area. The initiative is private and is promoted by María Begoña Balsa Puras, in her own name and representing her co-owning relatives, José Antonio Balsa García and María Dolores Carrasco Gutiérrez; the representative is Santiago Arias Encinas and the author of the document is the architect Fernando Frau Olmedo.

The municipality is governed by a PGOU whose revision was definitively approved partially by Order FOM/1408/2008, of July 30, remaining suspended in sector SU-NC 6 and in the scope of the PERI Las Tudas, the latter approved by Order FOM/1011/2011, of May 18. The regional file is 09/2026 and the municipal file is 2022/00005301K.

What changes in the planning

The modification is structured into two interventions on adjacent urban plots under the same ownership:

  • 1st Modification: modifies the municipal catalog of assets affected by environmental protection, removing the protection dictated for the building included in file PA-119, until the plot housing it is converted into one like its neighbor, with the same urban classification and its courtyard.
  • 2nd Modification: adjusts the alignments marked for the affected plots, to provide continuity of layout and visuals to the street, eliminate visible party walls and angled intersections, and improve the geometry and circulation of the surroundings.

Both interventions affect the planning map PO-4 BIS.

Three years of municipal processing

  • Initial approval: Plenary of the Medina del Campo City Council, on August 30, 2023, by absolute majority, with 14 votes in favor and 7 abstentions.
  • Public information: two months, announced in El Norte de Castilla on January 11, 2024, in BOCYL no. 20/2024, of January 29, and on the municipal Electronic Official Notice Board from January 30 to April 1, 2024.
  • Allegations: none, according to the certificate of April 5, 2024.
  • Provisional approval: Municipal Plenary, on June 25, 2026, unanimously.
  • Entry of the file into the Single Registry of the departments: July 3, 2026.
  • Technical and legal reports from the Urban Planning Service: July 30 and August 11, 2026.
  • Proposal from the General Directorate of Housing and Urban Planning: August 11, 2026.
  • Favorable report from the Council of Environment, Urban Planning and Territorial Planning of Castilla y León: session of September 9, 2026.

Sectoral reports and environmental assessment

The document was submitted to the mandatory prior reports, all of which were favorable, although the one from the General Directorate of Housing, Architecture, Territorial Planning and Urban Planning pointed out deficiencies to be corrected:

  • Provincial Council of Valladolid (July 12, 2023).
  • Government Sub-delegation (July 7, 2023).
  • General Secretariat for Telecommunications and Organization of Audiovisual Communication Services (July 27, 2023).
  • Duero Hydrographic Confederation (September 13, 2023).
  • General Directorate of Housing, Architecture, Territorial Planning and Urban Planning (December 4, 2023).
  • Cultural Heritage Commission of Castilla y León (January 16, 2024).
  • Territorial Environment Service of Valladolid: did not issue a report, which did not prevent the procedure from continuing.

The environmental process concluded with Order MAV/315/2024, of April 11, published in BOCYL no. 76/2024, of April 18, which determines that it is unlikely that significant effects on the environment will occur and that an ordinary strategic environmental assessment is not necessary.

Deadlines and appeals

The Order exhausts the administrative route, therefore a contentious-administrative appeal may be filed against it before the Contentious-Administrative Chamber of the High Court of Justice of Castilla y León, based in Valladolid, within a period of two months starting from the day following its notification. The full content of the planning instrument is available to the public at the electronic address of the Junta’s urban planning information system.

The decision closes a file opened in 2023 and represents the first loss of environmental protection for a facade in this section of José Zorrilla Street, with direct effects on the urban landscape and on the municipality’s catalog of protected assets. The change also clears the way for the development of two disused industrial plots, whose lack of utilization is described in the file’s own report as a “gap” without activity that economically and environmentally damages its surroundings.
