Aprobada la modificación menor del PGOU de Las Palmas sobre uso dotacional

The Plenary of the City Council of Las Palmas de Gran Canaria definitively approved on September 25, 2026, the Minor Modification of the General Urban Development Plan regarding the urban planning regulations for detailed planning for plots with endowment and equipment use. The agreement was made public via an announcement dated October 9, 2026, signed by the general secretary of the Plenary, María Mercedes Contreras Fernández, and is inserted in the Official Gazette of the Canary Islands (Boletín Oficial de Canarias) no. 214, of October 26, 2026, in section V. Announcements (Other announcements, Local Administration), with the official reference 3695. The modification was formulated and promoted ex officio by the City Council itself.

A process of more than two years

The initial approval was adopted in the plenary session of July 26, 2024, following deliberation by the Local Government Board on July 18, 2024. The public information period, consisting of forty-five business days, extended from September 2 to November 5, 2024, with announcements in the Official Gazette of the Province of Las Palmas (no. 97, of August 9, 2024), in the Official Gazette of the Canary Islands (no. 161, of August 16, 2024), and in the newspaper Canarias 7 (September 2, 2024).

The technical document was drafted by the Municipal Urban Management Company of Las Palmas de Gran Canaria, S.A. (Geursa). The processing is supported by articles 163 to 165 of Law 4/2017, of July 13, on Land and Protected Natural Spaces of the Canary Islands, and by article 103 of the Planning Regulations of the Canary Islands (Decree 181/2018, of December 26), with the plenary competence of article 123.1.i) of Law 7/1985, of April 2.

What the modification regulates

The objective is narrow: to readjust and correct Title IV of the Detailed Planning Regulations, relating to plots classified as Open Spaces, Endowments, and Equipment. The changes are concentrated in:

  • Chapters 4.1, 4.10, 4.12, and 4.14 of the detailed regulations and in the general system file SG-19.
  • A new regime of uses for plots classified as Offices (OF), with the use of Tourist Accommodation limited to the modalities of Urban Hotel and Emblematic Hotel.
  • Incorporation of Warehouse use, in the categories of Small Warehouse and Type I Commercial Warehouse, on the ground floor and basement levels (article 4.12.5).
  • Extension of these complementary, alternative, and authorized uses to the office building next to the Las Arenas shopping center (article 4.12.9) and to the building on Eufemiano Jurado street (article 4.12.7).

The Justification Report specifies that neither the classification nor the qualification of the land, nor the typological and volumetric parameters, are altered, but only the admissible uses.

Allegations: two accepted and two rejected

Four allegations were presented during the public information period, resolved in the plenary agreement:

  • Digitales, Asociación Española para la Digitalización (registry 149252): dismissed; it requested an express declaration of compatibility for the deployment of electronic communications networks.
  • Guerra Patrimonial FGG, S.L. (registries 149079 and 155716): dismissed; it claimed the reclassification of 442.10 m² of SG-54 La Mayordomía as rural land for infrastructure protection.
  • José María Lang-Lenton Españaque (registry 156851): partially upheld; regarding the Casa Ford (file ARQ-183, 22 Presidente Alvear Street), residential use and vacation rentals are rejected, but warehouse use is admitted.
  • Yudaya, S.L. (registry 159900): upheld; the uses of the building next to Las Arenas are equated to those of the remaining OF plots.

Adjustments for the Coastal Law and entry into force

The favorable report from the Directorate General for the Coast and the Sea, dated February 10, 2026, necessitated the introduction of corrections: the five hotel plots (HT) located within the protection easement of the Paseo de Las Canteras are excluded, and the building parking plot (AP) on Coronel Rocha Street, in La Isleta, is limited to the portion not affected by the easement. It is also clarified that SG-19 “Equipped urban park of the Estadio Insular” is only affected by the 500-meter influence zone. Additionally, the Plenary took note of a material error in the drafting of four OF plots within the scope of the “Vegueta-Triana” Special Protection Plan, which are not part of the modification.

The agreement will be sent to the Canary Islands Planning Registry and the Cartographic Council of the Canary Islands. Entry into force will occur fifteen business days after the publication of the full text in the Official Gazette of the Canary Islands, and against this act, final in administrative proceedings, a contentious-administrative appeal may be filed within two months before the Contentious-Administrative Chamber of the High Court of Justice of the Canary Islands (Las Palmas headquarters).

The decision directly affects owners of endowment land, developers, and hotel operators in the capital of Gran Canaria, who now have a wider range of uses in office buildings and hotels, while the City Council shields the network of facilities against changes to residential use.
