Por FactBox Admin

Anvers et Hasselt : de lourdes interdictions de gérer des entreprises

The Antwerp Enterprise Court, Mechelen division, issued on October 12, 2026, business bans of 7 years against Ziad Nawfal and 10 years against Necsea Denisa, pursuant to Article XX.229 of the Code of Economic Law. These decisions are published in the Belgian Official Gazette of October 15, 2026, under reference 2026/143066. On the same day, the Belgian Official Gazette published under reference 2026/143096 an 8-year ban imposed by the Antwerp Enterprise Court, Hasselt division, on Yusuf Yoldas.

The legal framework: Article XX.229 of the Code of Economic Law

Article XX.229 of the Code of Economic Law (WER) allows the enterprise court to prohibit a person, for a determined period, from operating a business personally or through a third party, as well as from exercising any function conferring the power to validly bind a legal entity. These measures are published in the Belgian Official Gazette, making them enforceable against third parties.

The three decisions published this October 15, 2026, originate from Antwerp jurisdictions and target individuals already involved in bankruptcy proceedings.

Mechelen: seven years for Ziad Nawfal, ten years for Necsea Denisa

The Antwerp Enterprise Court, Mechelen division, ruled on October 12, 2026:

  • Ziad Nawfal, born August 6, 1998, residing at 1785 Merchtem, Sint Huybrechtstraat 4/B012: prohibition, pursuant to Article XX.229 WER, from operating a business personally or through another person and from exercising any function conferring the power to validly bind a legal entity, for a period of 7 years effective from the judgment.
  • Necsea Denisa, born July 14, 1997, residing at 2801 Heffen, Ten Doorn 3: prohibition from operating a business, personally or through another person, for a period of 10 years effective from the judgment.

These decisions are signed by the clerk A. Paepen and published under references 2026/143063 and 2026/143066.

Hasselt: eight years for Yusuf Yoldas

The Antwerp Enterprise Court, Hasselt division, imposed on Yusuf Yoldas, born in Maasmechelen on July 23, 1979, and residing at 3630 Maasmechelen, Sneppenlaan (M) 27, a ban from operating a business, personally or through another person, for a duration of 8 years from the judgment, based on Article XX.229, § 1 WER. The court rejected the remainder of the public prosecutor’s request. The certified extract is signed by S. Geeraert and published under reference 2026/143096.

Bans following bankruptcies

The three individuals appear in bankruptcy files published in the Belgian Official Gazette:

  • Nawfal Services Comm V, Dokter Persoonslaan 20/1 à 2830 Willebroek, bankruptcy opened on November 27, 2023 (reference 20230245).
  • Necsea Denisa, bankruptcy opened on June 2, 2025 (reference 20250134), closed for insufficiency of assets without discharge.
  • Yusuf Yoldas, bankruptcy opened on January 11, 2022 (reference 20220005).

These publications serve as a reminder that the prohibition from operating a business is a sanction imposed by the business court, often following a bankruptcy, and is made public to inform third parties.

Scope for readers

For creditors, business partners, and trustees, these mentions in the Belgian Official Gazette constitute a warning signal: they allow for verification, prior to any business relationship, that a person is not subject to a prohibition from operating a business or exercising a management function. The imposed durations — 7, 8, and 10 years — are effective and run from the date of the judgment, which excludes any new entrepreneurial activity or management mandate during this period.
