Anulada la revocación de 9.920 euros de subvención a Reyman & Romero

The Official Gazette of Extremadura publishes this Thursday, in issue 209 of October 29, 2026, the Resolution of October 20, 2026, from the General Secretariat of Economy, Business and Trade, which provides for the execution of judgment no. 354/2026 of the High Court of Justice of Extremadura (TSJEX), which upholds the appeal of Reyman & Romero, CB and nullifies the revocation of 9,920 euros in subsidies. The official resolution, with reference 2026062707, orders the judicial ruling to be carried out in full and due effect and for the proceedings to be reversed.

The judgment, dated June 3, 2026, was issued by the Administrative Litigation Chamber of the Extremaduran high court when resolving ordinary procedure no. 701/2025, promoted by the legal representation of Reyman & Romero, CB against the Regional Government of Extremadura. The litigation centered on file 2024/16761V, relating to public aid whose continuity was questioned by the regional Administration.

The contested resolution and the file figures

The origin of the conflict is the Resolution of September 19, 2025, from the Directorate General of Business, which declared the total revocation of the subsidy granted via a resolution from that same management center on April 3, 2025. The affected amount totals 9,920 euros, a sum that the Administration intended to recover in full.

The upholding ruling contains three literal pronouncements:

  • The Resolution of September 19, 2025, from the Department of Economy, Employment and Digital Transformation, which agreed to the total revocation of the aid from file 2024/16761V, is annulled.
  • It is agreed to reverse the proceedings so that the defendant Administration accepts the payments made as valid and issues the relevant resolution.
  • There is no award of costs for either party.

The defense of the beneficiary was handled by the court representative Ms. Cristina Cardona Olivares, representing Ms. Isabel M.ª Romero Mata.

Chronology until the finality of the judgment

The processing following the judgment confirms its definitive nature. Decree no. 1, of July 29, 2026, from the Administrative Litigation Chamber of the TSJEX declared the judicial resolution final. Shortly thereafter, on August 6, 2026, the General Counsel of the Regional Government of Extremadura reported that the judgment had fully acquired the character of executable, which opened the way for the material execution now published.

The resolution expressly states that the payment of costs by the Administration is not applicable, as stated in the fourth legal ground of the judgment.

Competence and regulatory basis of the execution

Article 40.1 of Decree 1/2022, of January 12, which approves the Regulations for the organization and operation of the General Advocacy of the Regional Government of Extremadura, attributes the material execution of final judgments to the body competent by reason of the subject matter of the litigation. In this case, competence lies with the Secretary General of the Ministry of Economy, Employment and Digital Transformation, although it is delegated to the General Secretariat for Economy, Business and Trade by the Resolution of May 9, 2026, published in DOE no. 90, of May 13.

For its part, Article 9 of Decree 59/1991, of July 23, on administrative processing in the execution of judicial resolutions, requires the publication of the compliance resolution in the official gazette when the judgment annuls or modifies the contested act. The regulation considers it sufficient to insert the data of the plaintiff and defendant, the case number, and the content of the ruling.

The document appears signed in Mérida, on October 20, 2026, by the General Secretary for Economy, Business and Trade, María Celina Pérez Casado.

The ruling establishes a relevant criterion for the beneficiaries of regional grants: the revocation of a grant already paid requires sufficient motivation and, if annulled in court, obliges the Regional Government to consider the payments made as valid instead of claiming their return. The precedent applies to any similar file processed by the Directorate General for Business in which the justification of payments already issued is discussed.
