Por FactBox Admin

The Governing Council of the Regional Government of Andalusia has approved Decree 519/2026, of October 14, which creates the Social Council of the Center for Guidance, Entrepreneurship, Support, and Innovation for Employment of the Autonomous Community of Andalusia (COE-Andalucía) and regulates its composition and operating regime. The regulation is published in the Official Gazette of the Regional Government of Andalusia (BOJA) no. 202, of October 19, 2026, in section 1 of general provisions, with official reference 00344888. The decree enters into force on the day following its publication, that is, October 20, 2026.
The new body is established as a collegiate body for planning and social participation of the social agents provided for in article 20 of Law 9/2007, of October 22, of the Administration of the Regional Government of Andalusia, and is attached to the Andalusian Employment Service (SAE) Agency. Its headquarters shall be the city where the central services of the SAE are located.
The creation responds to a mandate from the Resolution of May 12, 2022, of the General Directorate of the State Public Employment Service, which qualified the Andalusian center and incorporated it into the Network of Public Centers for Guidance, Entrepreneurship, Support, and Innovation for Employment; its sixth provision expressly requires that the center have a Social Council chaired by the owning Administration. The framework is completed by article 88.2 of Royal Decree 818/2021, of September 28, and by the third additional provision of Order TES/1077/2023, of September 28, in application of article 8.5 of Law 3/2023, of February 28. The regulation is also supported by Investment 5 of Component 23 of the Recovery, Transformation, and Resilience Plan, funded by the Recovery and Resilience Facility.
SAE Presidency and nine memberships
The Social Council shall be chaired by the person holding the Presidency of the Andalusian Employment Service, replaced in case of absence, vacancy, or illness by the head of the organization’s General Management. The composition is completed with nine memberships:
- Four memberships representing the Administration of the Regional Government of Andalusia, designated from among the heads of governing bodies of the central services of the Departments and instrumental entities with competencies in labor intermediation and guidance, employment promotion, self-employment, and vocational training.
- The head of the General Management of the Andalusian Employment Service.
- Two memberships proposed by the most representative trade union organizations in Andalusia.
- Two memberships proposed by the most representative business organization in the autonomous community.
The Secretariat shall be held by the head of the Coordination of the SAE General Management, who shall attend with a voice but without a vote. The appointment of non-ex officio members corresponds to the head of the Regional Ministry of Employment, Enterprise and Self-Employment. The regulation mandates respect for the balanced representation of women and men when proposing representatives and establishes that membership in the body does not generate any right to remuneration, with expenses being borne by the represented body or organization.
Monitoring of the annual program and the COE Network
The decree assigns the Social Council functions of knowledge and monitoring, rather than direct management. These include knowing the actions and management carried out by the SAE regarding guidance, entrepreneurship, support, and innovation for employment; knowing the annual work and activity program of COE-Andalucía and its monitoring report once execution is completed; and knowing the annual activity Report of the COE Network. It is also assigned whatever functions are inherent to the planning and social participation in the center’s activity and those assigned by legal or regulatory provisions.
Annual meetings and simple majority
The Council shall meet at least once a year and whenever convened by the Presidency. The ordinary call must be issued with a minimum notice of ten business days, reduced to forty-eight hours in urgent cases. An extraordinary session may be convened by decision of the Presidency or at the request of at least four members.
Sessions may be held in person or remotely, with guarantees of identity, interactivity, and real-time intercommunication. For a valid constitution, the attendance of the Presidency and the Secretariat, or those replacing them, and at least half of the members is required; agreements are adopted by simple majority, and no matter outside the agenda may be deliberated unless all members attend, urgency is declared, and a favorable majority is obtained. The decree is signed by the president of the Junta de Andalucía, Juan Manuel Moreno Bonilla, and by the regional minister of Employment, Enterprise and Self-Employment, Rocío Blanco Eguren.
The text arrives as active employment policies face the final stretch of the execution of European funds and places Andalusian trade unions and employers’ associations in a stable monitoring forum for the public guidance center. The regulation does not imply an increase in expenditure or administrative burdens, according to the report accompanying the decree, and empowers the SAE General Management to issue the necessary instructions for its application.
