ANA inscribe la suspensión provisional del pozo Casco en Telica

The National Water Authority (ANA) registered Administrative Resolution No. RAE-ANA-DGRH-0172-2026, which modifies the concession title for the use of groundwater from five wells in favor of Frutas de Occidente, S.A. and records the provisional suspension of the point designated as “Pozo Casco” due to temporary closure in the municipality of Telica, department of León. The registration certification was published in La Gaceta, Official Gazette No. 195 on Friday, October 23, 2026, in the ANA resolutions section, under official reference Reg. 2026-01027.

The record was entered into the National Public Registry of Water Rights and Service Providers (RPNDAPS) under Perpetual Number 0127, Folios 186 and 187, Volume VII, of the Concession Title Registration Book. The legal framework invoked by the institution is Law No. 620, “General Law of National Waters,” published in La Gaceta, Official Gazette No. 169 on September 4, 2007; Law No. 1046, “Reform Law to Law No. 620,” published in La Gaceta, Official Gazette No. 217 on November 23, 2020; and Administrative Resolution No. 140-2019, “Appointment of the National Public Registrar of Water Rights,” dated December 20, 2019.

The registered resolution is not a new title, but a modification of a previous concession: the original title was granted via Administrative Resolution No. RAE-ANA-DGRH-0082-2026, issued on September 30, 2026, and notified on October 16, 2026, and its immediate precedent is Administrative Resolution No. RAE-ANA-DGRH-0082-2026 of May 20, 2026, registered on June 11, 2026, in Entry 0066, Folios 83 and 84, Volume VII, specifically regarding the use of “Pozo Casco.”

The suspension of “Pozo Casco”

The third resolution of the certification orders to “take note of the provisional suspension of groundwater use” at the point designated as “Pozo Casco” due to temporary closure. The location recorded in the document is as follows:

  • Basin: No. 68, named “Río Estero Real.”
  • Municipality: Telica, department of León.
  • UTM WGS84 Coordinates: 518674 E – 140226 N.

The published certification does not detail the maximum annual volume of use assigned to that point, nor the authorized use of the water, nor the duration of the suspension; nor does it specify the technical or administrative cause that prompted the temporary closure beyond that expression.

What the resolution modifies

The first resolution records Administrative Resolution No. RAE-ANA-DGRH-0172-2026, regarding the “Modification of the concession title for the use of groundwater from five (05) wells,” granted via Administrative Resolution No. RAE-ANA-DGRH-0082-2026 in favor of the company Frutas de Occidente Sociedad Anónima. The second resolution takes note of the modification of the first resolution of said title, issued on May 20, 2026, and recorded on June 11, 2026, in the previously cited entry and pages.

The process was promoted by engineer Ruth Aracelly Méndez Rivas, acting as Special Proxy of the commercial company, through a request submitted on October 16, 2026. Legal standing was accredited by Public Deed number 163, signed on August 19, 2019, before attorney Pastor Lovo Castellón, and by the Testimony of Public Deed number 20, signed on November 10, 2025, before attorney Giobis Benito Loásiga Sevilla.

Publication and signatures

The certification was issued at the request of engineer Ilsa Andrea Medrano Campbell, pursuant to the sixth resolution of Administrative Resolution No. RAE-ANA-DGRH-0172-2026, which orders the act to be published in La Gaceta, Diario Oficial within a maximum period of fifteen (15) calendar days. The document was signed in Managua at five minutes past eleven in the morning on October 16, 2026, by Luis Fernando Yescas García, National Public Registry of Water Rights and Service Providers of the ANA.

The same edition of the official gazette includes other water registry entries, including the modification of the title of a well for CEMEX Nicaragua, S.A., a concession title for a well in favor of Grupo Industrial El Granjero, S.A., and discharge permits for ILS Group, S.A., all processed in October 2026.

The registration of this suspension is important because it provides public record, in the book of concession titles, that the use of groundwater in the “Pozo Casco” is provisionally interrupted due to temporary closure in an agricultural area of Telica where the ANA maintains dozens of registered concessions; any inquiry regarding the validity of the right, its reactivation, or its authorized volume must be referred to entry 0127 of Volume VII and the resolution recorded therein.
