Alcobendas abre veinte parcelas de oficinas y hospedaje a vivienda protegida en alquiler

The Plenary of the Alcobendas City Council has delimited approximately twenty plots classified as tertiary offices and tertiary lodging in which the residential use of housing subject to a public protection regime for rent may be implemented, and has agreed on the non-application of the temporary accommodation regime in industrial use plots within the municipal district. The agreement was adopted in an ordinary session on September 24, 2026, and is published in the Official Gazette of the Community of Madrid no. 250, of October 20, 2026, section III (Local Administration), pages 486 to 488, with reference BOCM-20261020-46.

The decision is based on Law 2/2026, of June 11, on Urgent Measures for the Increase of the Supply of Publicly Protected Housing, which modifies Law 3/2024, of June 28, on Urban Planning Measures for the Promotion of Protected Housing. Articles 2.7, 3.6, and 4.5 of the latter empower city councils to, within four months from the entry into force of Law 2/2026 and by agreement of the Plenary, decide on the non-application of the respective regimes, establish additional restrictive conditions, or define the territorial areas for implementation.

The file incorporates a Technical Report from the Sub-directorate General of Urbanism dated August 28, 2026, which analyzes the urban planning circumstances of the municipality, and a Legal Report of the same date regarding the suitability of the proposals to the legal regime. The resolution was processed based on proposal PR/2026/3910, of September 8, 2026, and the competence corresponds to the Plenary in accordance with article 123.1.p) of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, with a simple majority of the members present.

Twenty office and lodging plots

The first point of the resolution delimits, for the purposes of article 2 of Law 3/2024, the areas for the implementation of protected rental housing on tertiary office or tertiary lodging land. The highest concentration is located in the Arroyo de la Vega Business Park (area 2), with ten plots:

  • TN-2 (avenida de la Vega, no. 1) and TN-1 (avenida de la Vega, no. 2).
  • TN-9 (calle Anabel Segura, no. 7), TN-6 (calle Anabel Segura, no. 10) and TN-7 (calle Anabel Segura, no. 14).
  • TS-18 (avenida de Bruselas, no. 5), TS-17 (no. 7), TS-16 (no. 13), TS-15 (no. 15) and TS-5-6 (avenida de Bruselas, no. 33).

The remaining enabled areas are plot E of Los Peñotes (area 3, calle Diego Salmerón, no. 4); two plots in area 6 of calle Cantabria and avenida Valdelaparra (nos. 2 and 2); three in API-2 Casablanca (area 8: T-5c1, avenida del Doctor Severo Ochoa, no. 25; T-5c2, calle Huelva, no. 16; T-4c, avenida del Doctor Severo Ochoa, no. 34); two in the Distrito Centro-Casco Antiguo (area 11, Bulevar Salvador Allende, nos. 8 and 16); and two in the Distrito Centro-Área Pintores (area 12, calle Pintor Murillo, no. 14 and calle Pintor Velázquez, no. 5).

Private equipment land and increased buildability

The agreement also opens private equipment land for protected residential rental use. These are three plots in the Distrito Norte (area 3), on Marqués de Valdavia street, nos. 128, 132, and 134.

Additionally, for the purposes of article 3 of Law 3/2024, two areas are delimited where the increase in buildability and density may be applied to plots intended for the construction of publicly protected housing: the plot on Marqués de Valdavia street, no. 111, and the one on avenida Olímpica, no. 6.

Industrial land is excluded from temporary accommodations

The fourth point of the agreement, adopted under article 4.5 of Law 3/2024, establishes the non-application throughout the municipality of Alcobendas of the regime provided for in said article for the implementation of temporary accommodation modalities on plots with an industrial use classification. The measure directly affects owners of warehouses and industrial land, who will not be able to utilize this route.

Deadlines, communications, and appeals

The Dirección General de Urbanismo, Vivienda y Licencias must send certification of the agreement to the general directorate competent in housing matters and to the one competent in urban planning of the Comunidad de Madrid within five business days of its adoption, in accordance with the sole additional provision of Law 2/2026. The agreement is published in the BOCM and through the electronic means of article 70 ter of the Ley de Bases de Régimen Local.

The text warns that the agreement ends the administrative route and that a contentious-administrative appeal may be filed against it before the corresponding Chamber of the High Court of Justice of Madrid within two months from the day following the publication of the announcement, according to article 46.1 of Law 29/1998, of July 13. The announcement was signed in Alcobendas on October 8, 2026, by the Director General of Urbanism, Housing, and Licenses, María del Mar Morales Baeza.

The agreement makes Alcobendas one of the municipalities using the four-month margin of Law 2/2026 to decide where protected rental housing is permitted on tertiary land, a step that reorganizes the office market in Arroyo de la Vega and closes the door to temporary accommodations in industrial estates.
