Alboraya suspends hotel licenses across the entire municipality for one year

The Alboraya City Council has cautiously suspended for one year the processing and granting of building permits for the implementation of new hotel tertiary uses throughout the municipal district. The decision, adopted by the Plenary in its ordinary session on July 30, 2026, is published in the Official Gazette of the Generalitat Valenciana (DOGV) number 10442, dated September 2, 2026, with the official reference DOGV-C-2026-27806.

The measure is adopted in order to facilitate the study of the reform of the urban planning of the municipality, in accordance with article 68.1 of the revised text of the Law on Land Use, Urban Planning and Landscape, approved by Legislative Decree 1/2021, of June 18, of the Consell (TRLOTUP). The agreement, which is final in administrative proceedings, was signed on August 27, 2026, by the acting mayor, Concepción Villena Sierra.

Scope of the suspension

The suspension affects all building permits that enable actions considered as construction according to current state and regional regulations, including those consisting of a change of use of the building or part thereof, provided that their purpose is new hotel tertiary uses. Territorially, the measure extends to the entire municipal district of Alboraya.

The following actions are excluded from the suspension:

• The subdivision of land.
• Demolition works.
• Mere renovation works that do not involve structural alteration, relating to buildings or parts thereof that have previously authorized tertiary use.

Effects on responsible declarations

The suspension extends to the effectiveness of the responsible declarations submitted as of the day of the publication of the agreement in the DOGV. Conversely, it does not affect responsible declarations submitted prior to that date, provided that at that time the documentation that must mandatorily accompany them according to current regulations was submitted to the Alboraya City Council.

Duration and appeals

The duration of the suspension shall be one year, after which it may be extended for another year, in accordance with article 68.2 of the TRLOTUP. Against the agreement, which exhausts the administrative route, the following appeals may be filed:

• An optional appeal for reversal (recurso de reposición) before the same body that issued the act, within one month from the day following the publication in the DOGV.
• A contentious-administrative appeal directly before the courts of this jurisdictional order based in Valencia, within two months from the day following the publication of the announcement.

The moratorium represents a temporary halt to the expansion of hotel supply in Alboraya, a municipality in the l’Horta Nord region with strong tourism and residential pressure. Developers and operators in the local tourism sector must wait for the city council to complete the reform of its urban planning to learn the new conditions for the implementation of hotel uses in the municipality.
