AGENEX estrena su segundo convenio colectivo con jornada de 35 horas semanales

The General Directorate of Labor of the Junta de Extremadura has ordered the registration in the Registry of Collective Labor Agreements and Accords and the publication of the II Collective Agreement of the Extremadura Energy Agency (AGENEX), which establishes a 35-hour weekly working day and a new professional classification system for its staff. The resolution, signed on October 7, 2026, by the Director General of Labor, Pilar Bueno Espada, is published in the Official Gazette of Extremadura number 202, dated October 20, 2026, with the official reference 2026062599.

The agreement was signed on August 6, 2026, by the company representation and by the staff delegates representing the workers, and is identified by the code 81100162012026. It is company-wide in scope and affects all AGENEX personnel regardless of the modality and duration of their contract, with the sole exception of personnel with senior management contracts. Its territorial application extends to all the agency’s workplaces within the autonomous community.

The registration is supported by Article 90 of the revised text of the Workers’ Statute Law, by Royal Decree 713/2010, of May 28, on the registration and deposit of agreements, and by Article 6 of Decree 187/2018, of November 13, on the distribution of competencies and creation of public registries regarding the execution of labor legislation. The text enters into force on January 1, 2026, regardless of the publication date, and extends until December 31, 2028.

35-hour working day and flexible schedule

Article 20 establishes a working day of 35 hours per week for each year of validity, from Monday to Friday, with a general schedule between 8:00 and 15:00 hours. Flexibility is structured into three rules:

  • Mandatory presence of all staff between 9:00 and 14:00 hours.
  • Start from 7:00 and finish up to 16:00 without prior authorization.
  • Work between 16:00 and 20:00 from Monday to Thursday, subject to prior communication and authorization from management.

The daily 20-minute break counts as effective time, December 24 and 31 are considered holidays, and trips with overnight stays on behalf of the agency are compensated with 30 euros per night. Ordinary vacations are 22 working days, extendable by seniority up to 27 working days after 30 years of service, with a preferred period from June 15 to September 15.

Four groups and seven professional levels

Chapter IV reorganizes the staff into four professional groups, defined by the required qualification (A, B, C, and D), to which seven functional levels are linked: Area Coordination, Department Head, Technician 1, Technician 2, Technician 3, Administrative Staff, and Administrative Assistant. Access to the two highest levels requires accreditation of more than seven and more than five years of experience, respectively.

The probationary period is set at six months for Area Coordination, Department Head, and Technicians 1 and 2; two months for Technician 3 and Administrative Staff; and one month for the rest. The agency commits to prioritizing internal promotion and informing legal representation before publicly offering a position.

Remuneration and salary review

The salary table ranges from 51,571.10 euros per year for level I of Area Coordination to 20,945.88 euros for level VII of Administrative Assistant. The base salary for group A is set at 1,765.67 euros per month in twelve payments, with two prorated extraordinary payments. The seniority supplement is recognized every three years of tenure and amounts to 540.26 euros per year.

The annual salary review is linked to the percentage that the Regional Administration applies to its public employees, conditional on the profit and loss account of the previous year of AGENEX not showing losses. Additionally, the supplement for temporary disability, maternity, paternity, and risk during pregnancy or breastfeeding guarantees one hundred percent of fixed remuneration.

Work-life balance, teleworking, and new protocols

The text incorporates a specific chapter on work-life balance with breastfeeding leave of one cumulative hour per day, reduction of working hours for legal guardianship, and individualized flexibility of the schedule, which requires the approval of the Joint Commission. This joint body must be established within 30 days following publication and resolve its rulings within a maximum of five days.

Within three months of coming into force, two pending agreements must be finalized: the one regulating teleworking and the one relating to the horizontal professional career supplement. The additional provisions add an action protocol for catastrophes and adverse meteorological phenomena, with the possibility of suspending or reorganizing activity, and an LGTBI plan for equal treatment and non-discrimination.

The agreement also includes a disciplinary regime that classifies minor, serious, and very serious offenses, with sanctions of up to two months of suspension from employment and pay or dismissal, and with express adherence to the Interprofessional Agreement on the Extrajudicial Resolution of Labor Conflicts of Extremadura (ASEC-EX).

The new labor framework of AGENEX organizes, for the first time in a single text, the conditions of a workforce that until now was governed by the previous agreement and by scattered accords. The combination of reduced working hours, a closed professional classification, and salary reviews conditioned on budgetary balance marks the baseline of the labor conditions of the Extremaduran energy agency until 2028, with two pending developments —remote work and professional career— that must be negotiated in the coming months.
