Adif abre el trámite de expropiación de 1.256 metros cuadrados en Maliaño

The Railway Infrastructure Manager (Adif) has opened the public information process prior to the declaration of the need to occupy the land required to build a new grade-separated crossing between platforms and improve accessibility at Maliaño Station. The announcement is published in the Official Gazette of Cantabria no. 204, dated October 23, 2026, with the official reference CVE-2026-8260, and affects three properties located in the municipality of Camargo. Interested parties have fifteen business days to submit allegations.

The public information process is opened in compliance with Articles 18 and 19.1 of the Compulsory Expropriation Law of December 16, 1954, and the corresponding articles of its Regulations, approved by Decree of April 26, 1957. The purpose is to allow any person to provide in writing the appropriate data to rectify possible errors in the published list or to oppose, for reasons of substance or form, the need for occupation.

The file refers to the “Project for the construction of a new grade-separated crossing between platforms and improvement of accessibility at Maliaño Station,” an action that affects consolidated urban land in the railway environment and Avenida de Parayas. The announcement was signed in Madrid on October 2, 2026, by the Director General of Planning, Projects, and Construction, Luis Llamas Martínez.

Three properties and 1,256 square meters

The specific and individualized list of affected assets and rights comprises three properties, all in Camargo, totaling 1,256 square meters:

  • Property Y-39.0165-0700 (cadastral reference 2175012VP3027N0001WH): owners Soemca Empleo SL, with address at Bo. Sierrapando 508, 39317 Torrelavega, and the Camargo City Council. It affects 204 m² of expropriation, 122 m² of easement, 285 m² of temporary occupation; total, 611 m².
  • Property Y-39.0165-0701 (Calle La Industria): owners the Camargo City Council and Adif, through the North Heritage and Urban Planning Area Management (Plaza Circular 2, 48008 Bilbao), as well as an unknown owner. It affects 163 m² of expropriation, 53 m² of easement, and 214 m² of temporary occupation; total, 430 m².
  • Property Y-39.0165-0702 (cadastral reference 2175023VP3027N): owners the Homeowners Association of Avenida de Parayas 6, Maliaño, and the Camargo City Council. There is no expropriation, but 145 m² of easement and 70 m² of temporary occupation are imposed; total, 215 m².

Overall, strict expropriation is limited to 367 square meters, while 320 square meters are subject to easement and 569 to temporary occupation. Therefore, most of the surface area is not lost in ownership but is instead encumbered or occupied during the execution of the works.

Where to consult and how to appeal

The expropriation documentation may be examined during business days and office hours at four locations:

  • The Government Delegation in Cantabria, calle Calvo Sotelo nº 25, 39071 Santander.
  • The Sub-directorate of Station Architecture, calle Titán nº 4-6, 28045 Madrid.
  • The Camargo City Council, calle Pedro Velarde nº 13, 39600 Muriedas.
  • The “Public Information” section of the Transparency Portal on the Adif website (www.adif.es).

Allegations must be addressed to the Sub-directorate of Station Architecture at the indicated address, with the express reference “Public information, regarding the declaration of the need for occupation, Project for the construction of a new grade-separated crossing between platforms and improvement of accessibility at Maliaño Station.” They may be submitted through the General Electronic Registry of the General State Administration or the Adif electronic office.

The fifteen-business-day period begins to count the day following the publication of the announcement in the Official Gazette of Cantabria, such that the calendar extends through the second half of October and the first days of November, excluding Saturdays, Sundays, and holidays.

Impact for those affected

The procedure does not yet declare the occupation, but it establishes the procedural moment in which owners can correct cadastral data, dispute ownership, or challenge the validity of the expropriation before the records are drawn up. For the residents of Avenida de Parayas and for the companies in the vicinity of Calle La Industria, the announcement specifies for the first time the exact area they will lose or see encumbered, an essential preliminary step for negotiating the fair price during the valuation phase.
