AABE removes a National Roadways site from its jurisdiction in Bahía Blanca
Por FactBox Admin

The State Property Administration Agency (AABE) has decommissioned a property of 1,853.50 square meters in the city of Bahía Blanca that remained under the jurisdiction of the National Highway Directorate, dependent on the Ministry of Economy. The decision was formalized through Resolution 68/2026 (RESFC-2026-68-APN-AABE#JGM), signed on October 28, 2026, and published in the Official Gazette of the Argentine Republic on October 29, 2026, in its First Section.
The administrative act was issued within the framework of Article 29 of the Annex to Decree No. 2,670/15, which provides that decommissioning implies both the change in the property’s status and the cessation of its ownership condition. The measure applies to an unused plot of land, free of occupants and buildings, according to the agency’s prior inspection.
The land and its cadastral location
The plot is located at Indiada St. S/Nº, in the town and district of Bahía Blanca, province of Buenos Aires, and is identified by the following data:
- District 7 - Circumscription II - Section B - Farm 157 - Block 157D - Plot 1B.
- Link to CIE No. 0600130511/1.
- Surface area to be decommissioned: 1,853.50 m², according to the sketch PLANO-2026-36831506-APN-DSCYD#AABE, which is included as an annex to the resolution.
The State Property Occupation and Use Report No. 201/2026, dated February 11, 2026, prepared by the Territorial Deployment Directorate, described the site as an unused plot of land, with unmaintained vegetation and grasslands and a fair state of conservation. The Cadastral and Ownership Sanitation Directorate had previously determined the ownership, cadastral, and registry data.
A 2008 agreement that was never approved
The property was originally allocated by Survey Plan 7-158-63 for expropriation purposes for the “Bahía Blanca Belt Road” project, which was never executed. According to a note dated March 9, 2026, from the National Highway Directorate, the site had already been decommissioned by Resolutions No. 4243/83 and No. 2978/83, and there are no current projects or future provisions involving it.
The immediate precedent for the dispute is an agreement signed on August 5, 2008, between the National Highway Directorate and the Municipality of Bahía Blanca to transfer various sections of national routes free of charge. That agreement required approval via decree from the National Executive Power, which was never formalized; nevertheless, the municipality took possession of the land via the Possession Takeover Act of August 28, 2008.
The AABE requested the restitution of the property via a note dated August 4, 2026, and the municipality completed it on August 13, 2026, through the “Possession Restitution and Delivery Act AABE-Municipality of Bahía Blanca.”
Custody and next destination
The resolution establishes the following administrative steps:
- The National Directorate of Highways (Dirección Nacional de Vialidad) must guarantee the safeguarding, integrity, and availability of the property until its new destination is determined, in accordance with Article 17 of Decree No. 1,382/12 and Article 32 of the Annex to Decree No. 2,670/15.
- This agency must be notified, and the measure must be recorded in the National Registry of State Real Estate.
- A copy of the proceedings shall be incorporated into files EX-2026-80356477-APN-DACYGD#AABE, EX-2026-23544289-APN-DACYGD#AABE, and EX-2016-01270196-APN-DMEYD#AABE, which continue their processing.
The regulation bears the signatures of Tania Yedro, president of the AABE, and Joaquín Sánchez Charró, vice president of the agency.
Relevance
With this resolution, the land on Indiada Street is formally removed from the orbit of the National Directorate of Highways and returns to the stock of properties managed by the AABE, which may assign it to another state purpose. The case highlights that the municipal occupation was sustained for nearly two decades based on an agreement without presidential approval, and that the regularization of state real estate assets is now advancing through administrative channels and involving restitution.
