The Urban Planning Agency imposes a first coercive fine in file PO-0249-2026
Por FactBox Admin

The director of the Urban Planning Legality Protection Agency, María Victoria Núñez López, issued on July 7, 2026, the resolution imposing a first coercive fine in case number PO-0249-2026. The Official Gazette of Galicia publishes this Thursday, October 29, 2026, the announcement of October 15 notifying the interested party, with ID 76813859T, after notification could not be carried out in its usual form.
The publication is carried out under Article 44 of Law 39/2015, of October 1, on the common administrative procedure of public administrations, which allows personal notification to be replaced by an announcement in the official bulletin when the receipt of the act by the recipient cannot be proven. The text appears in section VI, Announcements, within the autonomous Administration section, and bears the official reference CVE-DOG: 0vw14f82-xlj1-qfp8-ef47-09ntimier508.
The coercive fine is the instrument that the urban planning Administration uses to overcome the material resistance of the offender and force compliance with orders to restore legality. In this case, it is the first imposition, which places the case in the initial phase of forced execution: if the obligated person does not act, the body may repeat the fines and, if necessary, execute the restoration works at the offender’s expense.
An announcement that does not publish the full resolution
The Agency expressly states that the act is not reproduced in its entirety, in application of Article 46 of the same Law 39/2015. This means that the announcement does not include the amount of the fine, the daily or period amount applied, nor the description of the works or uses that motivated the urban planning legality case.
The interested party may consult the full text at the offices of the body, located at rúa dos Camiños da Vida, s/n, in the Witland Building, 1st floor, Salgueiriños, in Santiago de Compostela. The period for this consultation is ten business days counting from the day following the publication of the announcement in the Official State Gazette, since the notification is channeled through that state journal.
Once this period has elapsed, the notification shall be understood as produced for all legal purposes, even if the person did not appear to collect the text of the resolution.
Deadlines and means of appeal
The resolution ends the administrative route in its first phase and opens two possibilities for challenge, which can be summarized as follows:
- Appeal for reversal (recurso de reposición) before the director of the Urban Planning Legality Protection Agency, within one month from the day following the notification.
- Direct contentious-administrative appeal, without prior reversal, within two months, before the contentious-administrative section of the court of first instance in whose jurisdiction the affected property is located.
- Procedural basis: article 14.1, third rule, of Law 29/1998, regulating the contentious-administrative jurisdiction.
The choice of route is not automatic: whoever files for reversal first exhausts that possibility and can then go to the courts, while whoever waives the optional appeal has direct access to the judicial route.
Another file notified on the same day
The same announcement of October 15 serves to notify a second case of similar characteristics, published on the previous pages of the same issue of the bulletin. This is the resolution issued on July 6, 2026, by the same director, by which a first coercive fine is imposed in file PO-0084-2025, addressed to an interested person with DNI 34921632L (reference CVE-DOG: ts65l6o0-eti5-fgf8-kt36-b2poxjcevd62).
Both announcements share the structure, legal basis, consultation address, and appeal regime, which confirms a consolidated administrative practice of the Agency when the offender’s address is untraceable or when the attempt at personal notification fails.
Why it matters
The publication of these acts allows the Agency to proceed with the execution of the orders to restore urban planning legality without the failure to locate the offender paralyzing the procedure, a frequent situation in files regarding irregular works and uses. For affected readers, the warning is clear: once the deadlines have passed, the fine is final in the administrative route, can be repeated, and the Administration retains the power to materially execute the restoration of legality at the expense of the obligated party.
