The Urban Legality Agency orders the suspension of works in a rural center

The director of the Agency for the Protection of Urban Legality (APLU), María Victoria Núñez López, issued on July 31, 2026, the resolution ordering the immediate suspension of works carried out on rural nucleus land in file PO-0330-2026. The order is now notified via an announcement published in the Official Gazette of Galicia (DOG) number 184, dated September 28, 2026, after it was not possible to carry out personal notification to the holder of national identity document 06496863F.

A suspension order with immediate effect

The resolution, signed by the director of the APLU, orders the immediate cessation of works executed on rural nucleus land within file PO-0330-2026. The act concludes the administrative route and has direct effects on the affected person, who is obliged to stop the urban activity indicated by the Agency.

The announcement, dated September 17, 2026, is processed under Article 44 of Law 39/2015, of October 1, on the common administrative procedure of public administrations, which regulates notification by announcement when personal notification is not possible. The Agency is the competent autonomous body for protecting urban legality in Galicia.

Notification by announcement and consultation of the file

  • The interested person is identified solely by DNI 06496863F.
  • The full text of the resolution is not published, in application of Article 46 of Law 39/2015.
  • The complete file is available to the interested party at the APLU offices, in the Witland Building, in Salgueiriños, Santiago de Compostela.
  • The consultation period is ten business days, counted from the day following the publication of the announcement in the Official State Gazette.
  • Once this period has elapsed, the notification shall be considered completed.

Deadlines and avenues for appeal

Against the resolution, which exhausts the administrative route, the interested person has two options:

  • An optional appeal for reversal (recurso potestativo de reposición) within one month, counted from the day following the notification, before the director of the APLU.
  • A contentious-administrative appeal within two months, before the contentious-administrative section of the court of first instance in whose jurisdiction the affected property is located, in accordance with Law 29/1998, regulating the contentious-administrative jurisdiction.

Legality restoration file

The same DOG publishes the announcement of the agreement to initiate the urban legality restoration file PO-0330-2026, also adopted on July 31, 2026, by the director of the APLU and notified via the same route. In this process, the interested person has fifteen days, from the day following the notification, to present the documents and justifications they consider pertinent and, if applicable, propose evidence specifying the means they intend to use.

The complete sequence —the initiation of the proceedings and the suspension order— is thus contained in two consecutive announcements in the same issue of the bulletin, which allows the administrative trail of the coercive action to be tracked from its beginning.

The publication of these announcements has an immediate practical effect for the neighbors and owners of the surrounding area: the suspension prevents the continuation of a work considered illegal on rural nucleus land while the legality restoration proceedings are resolved. Furthermore, notification by announcement ensures that the procedure advances even if the affected person cannot be located, and opens the legal deadlines for them to consult the file or appeal the decision of the APLU.
