Zurbarán launches a coexistence ordinance with fines of up to 3,000 euros
Por FactBox Admin

The Minor Local Entity of Zurbarán now has its own ordinance on security and citizen coexistence in public spaces, the full text of which is published in the Official Gazette of the Province of Badajoz on Wednesday, September 30, 2026 (Announcement 3711/2026). The initial agreement of the Neighborhood Board was automatically elevated to final status as no claims were filed during the public exhibition period, and the regulation will enter into force the day after the full text is published in the gazette. The ordinance consists of 124 articles and establishes fines of up to 3,000 euros.
The publication is carried out in compliance with article 70.2 of Law 7/1985, of April 2, regulating the Bases of the Local Regime. The text is issued under the protection of articles 4.1 sections a) and f) and 84 of that same law and article 128 of Law 39/2015, of October 1, and conforms to Law 40/2015 regarding the legal regime of the public sector.
The ordinance is structured into four titles, two additional provisions, one transitional provision, one repealing provision, and two final provisions, and incorporates as an annex a catalog of infractions and sanctions to facilitate the work of agents and instructors. Among its references are Organic Law 4/2015, of March 30, on the Protection of Citizen Security, Law 17/2010, of December 22, on associations of municipalities and minor local entities of Extremadura, and the work of the FEMP.
Rules of conduct in public spaces
Title II, divided into nine chapters, regulates daily conduct in streets, squares, and municipal facilities. It addresses the visual degradation of the environment, the cleanliness of the road network, physiological needs and animal care, the deterioration of urban furniture, unauthorized games and activities, begging, the offering of sexual services, street vending, and noise pollution.
- Unauthorized graffiti: minor infraction, up to 750 euros; on monuments or listed or protected buildings, very serious, from 1,500.01 to 3,000 euros.
- Avoidable noise in dwellings between 10:00 PM and 8:00 AM, and loading and unloading of goods between 10:00 PM and 7:00 AM.
- Watering balconies and windows only between 6:00 AM and 8:00 AM and between 11:00 PM and 1:00 AM.
- Defecating, urinating, or spitting in public spaces: up to 300 euros, with an aggravated classification in high-traffic areas or areas frequented by minors.
Sanctioning regime and amounts
Article 117 sets the economic limits: very serious infractions up to 3,000 euros, serious up to 1,500 euros, and minor up to 750 euros. Article 116 classifies infractions as minor, serious, and very serious in accordance with article 140 of Law 7/1985, based on the intensity of the disturbance and the damages.
The acknowledgment of the infringement or voluntary payment prior to the resolution reduces the penalty by 20%, with cumulative reductions. Infringements prescribe in six months (minor), two years (serious), and three years (very serious), and penalties in one, two, and three years respectively. The ordinance allows for the substitution of fines with attendance at training sessions, community service, or other activities of a civic nature, upon request by the interested party, and provides for the specific protection of minors.
Scope, validity, and appeals
The regulation applies to the entire municipal area and to all natural or legal persons within it, regardless of their legal-administrative status. Reported non-resident persons must identify themselves and certify their habitual residence and place of accommodation in the municipality.
Entry into force will occur the day following the publication of the full text, once the period of 15 business days provided for in article 65.2 of Law 7/1985 has ended. The first final provision requires the ordinance to be reviewed and updated every two years. An administrative appeal may be filed against the agreement before the Administrative Chamber of the High Court of Justice of Cáceres within two months, in accordance with article 46 of Law 29/1998. The announcement appears signed by the Mayor-President, Sara Chavero Romero.
The ordinance provides the smaller local entity with a single framework to resolve the most common coexistence conflicts and unifies dispersed sectoral regulations into a single text. Residents and visitors now have clear rules of behavior in public spaces and a previously known schedule of penalties, with special attention to noise, cleanliness, and the care of urban furniture.
