Yeles renegotiates its job offer following CCOO appeal

The Yeles City Council has once again approved its Complementary Public Employment Offer for the 2026 fiscal year, after reversing the procedure and submitting it to collective bargaining following an appeal filed by CCOO. The decision is recorded in the Official Gazette of the Province of Toledo, number 159, dated August 21, 2026, pages 53 and 54, via the Mayoral Decree signed on August 18, 2026, by Mayor María José Ruíz Sánchez.
An appeal that forces a step back
The first version of the offer was approved by Mayoral Resolution No. 2026-0254 on July 29, 2026, and published in the provincial gazette on July 31. However, on August 4, 2026, the CCOO City Services Federation of Toledo filed an optional appeal for reversal, requesting its annulment because it had not been previously submitted for negotiation in the General Negotiation Table.
On August 6, 2026, a Mayoral Decree upheld the appeal and agreed to reverse the procedure to the moment immediately preceding the approval, in order to incorporate the collective bargaining process provided for in Article 37 of the Recast Text of the Law of the Basic Statute of the Public Employee. With the Table convened for August 13, 2026, the proposal was submitted for negotiation, and the session was held in compliance with said article and Article 151 of Law 4/2011 on Public Employment of Castilla-La Mancha.
The position subject to the offer
The complementary offer aims to fill one vacant position for a General Administration Technician, which has the following characteristics:
- Subgroup A2, belonging to the General Administration Scale, Technical Subscale.
- 1 position, with an access system via open competition/examination.
- Position created in the City Council’s personnel staff with budget allocation.
- Became vacant due to the definitive appointment of its previous holder through the free designation system.
Filling the position is considered necessary to guarantee the functioning of municipal services: the municipality, with approximately 8,000 inhabitants, requires civil service personnel from Subgroup A to provide technical-legal support to municipal bodies and ensure the normal exercise of administrative functions.
Regulatory framework and processing
The proposal is formulated in accordance with Article 70 of the Recast Text of the Law of the Basic Statute of Public Employees (Royal Legislative Decree 5/2015, of October 30), Article 91 of Law 7/1985, Regulating the Bases of the Local Regime, Article 128 of Royal Legislative Decree 781/1986, the Law 4/2011 on Public Employment of Castilla-La Mancha, Law 39/2015 on the Common Administrative Procedure, and the General State Budget Law regarding the staff replacement rate.
The decree provides for its publication in the Official Gazette of Castilla-La Mancha, in that of the province of Toledo, and on the notice board of the municipal electronic headquarters, and orders the continuation of the processing with the approval of the regulatory bases and the call for the selection process.
Relevance for readers
The resolution confirms that collective bargaining is an essential step in the approval of public employment offers, and that its omission may annul the procedure. For applicants, the position of General Administration Technician is formally called for the 2026 fiscal year, pending the bases and the call for the selection process via open competition and examination.
