Western Australia gazettes Tranche 10 electricity market rules with staged start

Amber-Jade Sanderson, Minister for Energy and Decarbonisation, has given notice of market rules cited as the Electricity System and Market Amendment (Tranche 10) Rules 2026, published in the Western Australian Government Gazette No. 122 of 25 September 2026. The rules were made under regulation 7(5) of the Electricity Industry (Electricity System and Market) Regulations 2004, which sit under the Electricity Industry Act 2004. The notice, carried in the Energy and Economic Diversification section at page 2057 under reference EE401, sets out three separate commencement dates for the amending rules.

Three commencement dates

The instrument splits its amendments into three schedules, each with its own start time, all expressed in Western Standard Time:

• Schedule 1 amending rules commence at 8:00 AM (WST) on the day after the day of publication of the instrument in the Gazette.
• Schedule 2 amending rules commence at 8:00 AM (WST) on 1 October 2026.
• Schedule 3 amending rules commence at 8:00 AM (WST) on 1 October 2027.

With the notice published on Friday 25 September 2026, the Schedule 1 changes take effect the following day, while the remaining tranches are deferred to the start of October in 2026 and 2027 respectively.

Ordering against other market rules

The notice also addresses what happens when the new amending rules land on the same day as other instruments. Where market rules made by the Minister under regulation 7(5) before the date of this notice are specified to come into operation on the same day as the Tranche 10 amending rules, the Tranche 10 rules come into operation immediately after the commencement of those earlier rules. That sequencing provision is intended to fix the order of operation where commencement dates coincide.

Availability and authority

The notice states that a copy of the Electricity System and Market Amendment (Tranche 10) Rules 2026 is available on the website of the Coordinator for Energy, the body that administers the electricity system and market rules in the State. The instrument is dated at Perth this 17 September 2026 and signed by Amber-Jade Sanderson, MLA, Minister for Energy and Decarbonisation. The notice was published by authority of the Government Printer, Andrew Jones, in the 25 September 2026 edition of the Gazette.

The gazetted notice itself does not reproduce the text of the three schedules; it records the citation, the legal basis, the commencement timetable and the sequencing rule, and directs readers to the Coordinator for Energy for the full instrument.

The staged timetable means participants in the State’s electricity system and market will need to track two further commencement dates beyond the immediate changes. Because the amendments are split across three schedules taking effect on three different dates, the practical effect of the instrument will unfold over more than a year, with the final tranche not commencing until 1 October 2027. Anyone relying on the amended market rules should work from the version published by the Coordinator for Energy rather than the gazette notice alone.
