Villasandino approves the fee for the phytosanitary water charging point

The Villasandino City Council has finalized the fiscal ordinance regulating the operation of the water filling point for tanks containing phytosanitary products, the full text of which is published in the Official Gazette of the Province of Burgos no. 178, of September 18, 2026, section III. Local Administration (reference BOPBUR-2026-03865). The regulation comes into force at the moment of its final publication and sets the annual fee to be paid by the municipality’s farmers for using the service.

Plenary approval without claims

The Plenary of the Villasandino City Council, in a session held on June 16, 2026, agreed to provisionally approve the ordinance. As no claims were filed during the public exhibition period, the agreement was automatically finalized, in compliance with article 70.2 of Law 7/1985, of April 2, regulating the Bases of the Local Regime.

The ordinance is based on article 25.1 of the same law, which recognizes the municipality’s competencies in environmental protection, health, and water supply. The filling point is located in polygon 510, plot 558, and ownership belongs to the Villasandino City Council. The announcement is signed by the mayor, Ángel Mesón Miguel, in Villasandino on September 8, 2026.

One euro per hectare and half a euro per tree

Article 10 sets the annual fee for the use of the filling point:

• Rural rustic estates within the municipal district of Villasandino: 1 euro per hectare.
• Irrigation of trees located within the municipal district: 0.50 euros per tree.

The service operates uninterruptedly 24 hours a day, although the city council may close it when low temperatures raise fears of frost and damage to the pipes, and may restrict or suppress it in situations of water scarcity.

Prior registration, personal key, and prohibitions

To use the filling point, it is necessary to request registration with the Villasandino City Council using the standard form in Annex I. Once notified in writing and the fees are paid, each user is provided with an exclusive-use key, the transfer of which to third parties is strictly prohibited. Unless a written notice of cancellation is provided, requests are understood to be renewed on January 1 of each year.

The reservoir may only be used to fill tanks intended for agricultural treatments. The following are prohibited:

• Mixing phytosanitary products at the water intake point.
• Washing equipment and pouring its contents at the filling point.
• Depositing phytosanitary containers, which are considered hazardous waste according to Law 7/2022, of April 8, on Waste and Contaminated Soils for a Circular Economy.
• Washing implements, tractors, cars, or other vehicles.
• Using the water for the irrigation of vegetable gardens and gardens.

Sanctions of 100 euros per infringement

Title III defines as infractions the total or partial failure to comply with the obligations of the ordinance, including damage to the facilities or the transfer of the key. The party responsible is the key holder who has made improper use of the service, and minor infractions are penalized with a fine of 100 euros for each occurrence.

An administrative appeal may be filed against the agreement before the Contentious-Administrative Chamber of the High Court of Justice of Castilla y León, based in Burgos, within two months from the day following the publication of the announcement, in accordance with Article 46 of Law 29/1998, of July 13.

The entry into force of the ordinance provides the municipality with its own framework for a service that until now lacked specific fiscal regulation, and transfers to farmers an annual cost proportional to their area or the number of trees, while establishing clear environmental limits to prevent spills and mixtures at the intake point.
