Villanueva eases the transfer of stalls in the food market

The City Council of Villanueva de la Serena has definitively approved specific modification number 2 of the Market Regulations, which removes the obligation to wait two years to exercise the right to transfer stall concessions. The measure, adopted by the Plenary of the Corporation, is published in the Official Gazette of the Province of Badajoz number 177, dated September 16, 2026, via Announcement 3605/2026.

The modification affects article 15.4 of the Regulations and enters into force once the period provided for in article 65.2 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, has elapsed.

A change in article 15.4

The previous text of the Regulations established that the right of transfer could not be exercised until two years had passed since obtaining the concession, even when it had been obtained through mortis causa or inter vivos transmission, unless there was a justified cause such as retirement or a declaration of invalidity of the holder.

The new wording eliminates that waiting period and provides that:

• The right of transfer may be exercised from the moment the concession is obtained.
• The transmission must be authorized by the City Council.
• The requirements established in the Regulations must be met.

Processing and background

The Market Regulations were definitively approved by the Plenary in an ordinary session on July 23, 2025, and published in the Official Gazette of the Province number 145, dated July 31, 2025. It was subsequently modified by agreement of the same body on March 30, 2026, whose definitive approval was published in the Official Gazette of the Province number 100, dated May 28, 2026.

The initial approval of this specific modification was adopted in an ordinary session on July 22, 2026, and the agreement was submitted for public exhibition for a period of thirty days, without any claims or suggestions being presented, according to the announcement published on the notice board of the Town Hall and in the Official Gazette of the Province on the following July 28.

Appeals and validity

The definitive approval of the regulatory modification ends the administrative route, in accordance with articles 52.2.a) of Law 7/1985 and 114.1.c) and d) of Law 39/2015, of October 1, on the Common Administrative Procedure. A contentious-administrative appeal may be filed against it before the Contentious-Administrative Chamber of the High Court of Justice, based in Cáceres, within two months from the publication of the announcement.

The announcement is signed by the mayor, Ana Belén Fernández González, and is made public for general knowledge.

Impact for merchants

The removal of the two-year waiting period facilitates mobility and the renewal of market stalls by allowing a concessionaire to transfer their stall from the moment the concession is obtained, subject to municipal approval. The measure directly benefits the merchants of the Villanueva de la Serena food market, who gain flexibility to transfer their businesses without the waiting periods that previously applied.
